Gaiser case

Gaiser himself does not admit guilt, says his lawyer Vyacheslav Leontiev. But even during the arrests of the leadership of the republic, it became known in court that ex-senator Samoilov had confessed.

Komi factor

A criminal case of fraud against Gaiser and his subordinates was initiated a year ago. Separate proceedings have been separated from this case against former and current top managers of T Plus, an Interfax source said.

Gaiser's lawyer Vyacheslav Leontiev told RBC that his client had tense relations with the management of the Renova company. “There were conflicts between them due to the fact that Gaiser forced Renova to maintain the facility in working condition. This is not the first time Renova managers have appeared in the Komi fraud case. Renova structures have had interests in Komi since the late 1990s: in 1997, its aluminum holding SUAL became a major shareholder of the Timan Bauxite company, which owned a license to develop the Sredne-Timanskoye deposit, whose bauxite reserves amounted to about a third of the all-Russian . The project for its development included the construction of a railway, an alumina refinery and an aluminum smelter and was estimated at over $2 billion. For a long time, SUAL tried to attract a partner to it and at the same time increased its own stake in Timan's Bauxite. In 2003, Torlopov refused the pre-emptive right to buy out 25% of Bauxite Timan in favor of Vekselberg's company, Forbes magazine wrote. To resolve issues in the republic, the businessman took Zarubin to work, previously RBC was a source close to the leadership of one of the neighboring regions. But a source close to Renova denied this: by the time the former regional official was hired, Renova was already actively represented in Komi and even built the first private railway line in Russia there.

In October 2015, Zarubin was in absentia at the Basmanny Court, but Renova denied any connection with him in every possible way: he has not been working in the company since 2009. At that time, searches in Renova in connection with the Gaiser case were not reported.

About a month ago, a new scandal erupted in Komi. On August 9, the acting head of the republic, Sergey Gaplikov, wrote a letter to President Vladimir Putin, in which he complained about the emergency state of the Vorkuta CHPPs, which T Plus put up for sale. A few days later, on August 17, he discussed this issue with the president during a personal meeting, which was shown on central television.

“Vladimir Vladimirovich, I would like to ask the government to intensify work in this regard, provide us with assistance so that we bring the system into the necessary working condition during the heating season. And I wanted to ask that law enforcement agencies be instructed to figure out what the reason is,” Gaplikov addressed the head of state. “Definitely, we will. This irresponsibility must be stopped,” Putin promised.

The very next day, the Prosecutor General's Office announced that it had begun checking the readiness of Vorkuta's heat supply system for operation in winter conditions. “Together with law enforcement and regulatory authorities, a legal assessment will be given to the reasons for the failure by the operator of the thermal power plant to take measures for its proper maintenance and repair,” she said.

At the end of August, the head of T Plus, Boris Vainzikher, reported to Deputy Prime Minister Arkady Dvorkovich, who oversees the fuel and energy complex, on the modernization program for Vorkuta CHP power facilities until 2019 in the amount of more than 1.7 billion rubles. Whether these companies are related to the former leadership of Komi is unknown.

The defendants in the criminal case (about bribes to Komi officials) are Mikhail Slobodin, Yevgeny Olkhovik, Boris Vainzikher, who were successively the leaders of the IES from 2007 to 2014, as well as other as yet unidentified persons, Markin said. This structure entangled with its tentacles nineteen regions of Russia. It is in these regions that a critical situation has developed in the sphere of housing and communal services, the amount of damage can be comparable to the budgets of these regions.

This scheme leads to the fact that the more heat is lost through leaky pipes, the greater the revenue of T Plus, and, thanks to the bribery of regional energy commissions, the the tariff goes up next year.

The scheme of work is the same in all regions. In detail, with documents and photographs, I analyzed it using the example of several cities in the Sverdlovsk region: Yekaterinburg, Pervouralsk, Kamensk-Uralsky, Polevskoy, in the most detail in Nizhnyaya Tura, where damage was caused to the city more than 1 billion rubles!

The main essence of the machinations of Vekselberg is as follows:

– the head enterprise, PJSC T Plus, is engaged in the production of thermal energy in these territories, and its subsidiaries (LLC STK, CJSC KTK, etc.) provide services for the transmission of thermal energy. At the same time, the property of distribution networks is mainly owned by municipalities and is most often used on a lease basis;

- all funds collected by grid companies (STK, UTK, etc.) go almost in full to pay for heat, and the higher the level of losses in the networks, the more the founder of the heat grid organization, PJSC T Plus, receives, and the more higher tariff next year;

- in areas where heat sources of PJSC "T Plus" (CHP, GRES) are present, the main task of the subsidiary grid organization is 100% payment for heat released from the source, while the more heat is released, the more tariff funds are spent on its payment , to the detriment of the restoration of fixed assets belonging to the municipalities;

- the main activity of these network organizations for the operation of facilities is reduced to emergency and current repairs at minimal cost, in violation of SNiP and regulatory guidelines. Local “patched” repairs are made, pipelines are laid without thermal insulation, major repairs are not carried out, thermal insulation of external highways is not carried out, the hydraulic regime is not adjusted;

- such an approach leads to an increase in losses during the transportation of thermal energy and heat carrier, an increase in losses of the grid organization, an increase in the volume of purchases of heat from a source (owned by the founder of this organization), and, as a result, an increase in the final tariff for the population;

- in the tariff, these organizations include the amount for the current and major repairs of fixed assets of no more than 2% of annual revenue, and the Regional Energy Commissions accept this, although it is obvious that the accumulated depreciation is constantly increasing and the equipment is completely unusable for ten years of such “operation” (there is negligence and corruption component in RECs: Vekselberg's people are sitting there too!);

- all this leads to a constant increase in tariffs due to fictitious losses of the grid organization. At the same time, constantly parent company's revenue grows, producing thermal energy - PJSC "T Plus";

- when the physical resource of network facilities and distribution networks is depleted, the grid organization leaves the territory, incurring documented losses, but at the same time providing revenue to the parent company on the source of heat (generation), leaving fixed assets to the owner (state, municipality) in disrepair, not only preventing their normal operation, but also causing a large number of interruptions in the heat supply of the population (accidents);

- when supplying thermal energy, PJSC "T Plus" is not guided by the readings of metering devices, but determines the scope of supply arbitrarily voluntarily, actually distributing all costs to consumers and receiving excess profit at the expense of residents;

– with virtually complete failure to implement the investment programs established by the regional Government, the T Plus Group companies constantly increase tariffs, and the growth of these tariffs always significantly outstrips the growth for similar organizations. Again, there is a provision of preferences from the regulatory authorities!

In fact, not only local authorities, but also law enforcement cover the destruction of the housing and communal services system of entire cities and regions of our country.

Let me emphasize that the result of the activities of Vekselberg's companies, in addition to rendering municipal property unusable, is an ever-increasing tariff burden on the population and enterprises of the Sverdlovsk region, which has increased due to the "losses" of the grid organization.

A striking example is the situation in the city of Nizhnyaya Tura, where LLC Sverdlovsk Heat Supply Company (hereinafter referred to as STK LLC) in the period from 2004 to 2014 never did a tune-up the hydraulic regime of networks, which resulted in an overestimated coolant flow to ensure quality parameters for consumers; did not carry out major repairs and pressure testing of intra-quarter networks in the proper amount, as a result, the number of ruptures per year amounted to more than 170 PC.; the volume of heat energy losses during transportation amounted to more than 50% !!!

And all of the above led to the need increase the volume of heat purchases by several times at a source owned by PJSC T Plus, increasing its income, while the cost of restoring municipal property is more than 1 billion rubles.

Of course, first of all, the fruits of such a “business” affect the ordinary population, especially state employees and the elderly.

Separately, it should be noted that Vekselberg's companies generally do not execute investment programs approved by the Orders of the Government of the Sverdlovsk Region:

– in the period from 2004 to 2014, STK LLC operated heat supply facilities located on the territory of the Nizhneturinsky urban district, on the basis of a property lease agreement No. 32 dated 06/01/2004, while the tariffs of STK LLC included the costs of implementing investment program activities which increased the tariff burden on consumers, including the population;

– according to the Decrees of the Government of the Sverdlovsk Region dated 12/17/2012 No. 2543-RP and dated 08/13/2012 No. 1209-RP, the investment programs of STK LLC for 2013, 2014-2015, respectively, were approved, from which it follows that STK LLC is obliged carry out work on the reconstruction of the boiler house and the dispatching of heat sources and pumping stations for 6.8 million rubles, and work on the dispatching of heat sources and pumping stations for 7 million rubles. Works of LLC "STK" not fulfilled at all.

- at the same time, most of the works of STK LLC during the operation period were of an emergency nature, however, they were presented to the Administration of the Nizhneturinsky urban district (Lessor) as capital works with the provision of relevant certificates of work performed.

Grid organizations (subsidiaries of PJSC "T Plus"), receiving funds from the population and other consumers, dispose of them at their own discretion - mainly by directing them to purchase thermal energy from their founder and increasing its revenue, to the detriment of other cost items established by the Sverdlovsk REC areas.

And this is despite the fact that in every gigacalorie of thermal energy supplied and every ruble received as payment for thermal energy from consumers, there is both an investment component and the cost of capital and current repairs.

Over the past few years, the tariffs of PJSC "T Plus" and subsidiaries have been growing by 15% or more, and this growth was annually higher than that of similar grid organizations in the Sverdlovsk region and similar sources of the so-called combined heat and power generation, respectively.

A detailed analysis of the decisions of the Regional Energy Commission of the Sverdlovsk Region for the period from 2013 to 2016 and decisions on tariffs for the upcoming 2017 is required

I am sure that for several years the Regional Energy Commission of the Sverdlovsk Region provided Vekselberg companies with unjustified preferences in the form of inflated prices and tariffs for their services and goods.

There is someone here to ask questions, especially since the Moscow leadership of the REK was arrested in early August, which cannot but rejoice.

And who to rob Vekselberg doesn't care, even if these are state-owned factories producing stuffing for "Yarsov".

So, it turned out that in September 2015, in the course of preparation for the heating season of 2015-2016 and checking the complex of metering devices from the new power unit of the Nizhneturinskaya GRES, the volumes of heat energy supply recorded by commercial metering devices of NTGRES differ significantly from the volumes of supply in invoices for the period from October 2014 to the present. The total amount of regularly overstated invoices amounted to at least 95 million rubles in less than a year and a half.

These facts were identified and recorded by the employees of LLC "City energy service company"(heat supply organization of the city of Nizhnyaya Tura on the right of a concession agreement) together with an independent expert organization, during the commission reading of meter readings (archival values) in January 2016.

And the Nizhneturinskaya GRES, privatized by Vekselberg, is also a supplier of thermal energy for the ZATO Lesnoy City, and this energy is paid for military nuclear plant "Elektrokhimpribor".

Taking into account that the amount of theft from GSECO LLC (Nizhnyaya Tura) amounted to at least 95 million rubles, and the volume of consumption of ZATO Lesnoy City is three times higher, the amount of damage (theft) in relation to FSUE Electrokhimpribor Combine » is at least 285 million rubles!

Since the heads of PJSC "T Plus", JSC "Energosbyt Plus" and other subsidiaries (dependent) companies are the same persons with practical experience and knowledge in the field of energy, it is obvious: Vekselberg's dogs are doing all these outrages on purpose!

I'm sure there are:

1) fraud by a group of persons on an especially large scale;

2) causing damage to state (municipal) property;

3) appropriation of funds intended for the implementation of investment programs, capital and current repairs of municipal property;

The issue of economic and political occupation of the Ural region by Viktor Vekselberg.

The depth of penetration of a person born in the Lviv region, living in Switzerland and doing business in the United States, into the military-industrial region of Russia, was a shock to the general public.

It was also noteworthy that the oligarch is only interested in those types of business where nothing needs to be produced: know, collect rent from the population and industries.

With the assistance of local governors, Vekselberg captured:

20 thermal power plants in the Sverdlovsk Region, Perm Territory and the Komi Republic;

Kizelovskaya GRES, Shirokovskaya and Verkhoturskaya HPPs;

35 boiler houses;

Great schemer

The central object of this fascinating story will be the company PJSC "T Plus". Until recently, it had a different, very well-known name - IES-Holding. It is part of an empire called Renova, controlled by Viktor Vekselberg and his classmate and partner, US citizen Leonard Blavatnik.

Exactly at "T Plus" includes numerous power generating enterprises of the Urals, listed above. The organization of heat delivery to the homes and enterprises of the region is carried out by the subsidiaries of this company - LLC STK and CJSC KTK. Heat is delivered by these companies in Yekaterinburg, Berezovsky, Verkhnyaya Pyshma, Kamensk-Uralsky, Pervouralsk. Until recently, they also worked in Nizhnyaya Tura, Kachkanar and Polevskoy. We will return to the question why STK and KTK left these cities and towns.

It is important to note only that these subsidiaries are engaged in precisely organization delivery and service networks, the heating pipes and heat points themselves belong to municipalities, that is, they are state property. STK LLC and KTK CJSC use them on a leasehold basis.

Now let's move on to the most interesting - the scheme according to which Vekselberg cheats with warmth and rip off consumers.

The task of the T Plus subsidiaries involved in the delivery of heat is one hundred percent payment for the heat that was sent on the way to the consumer at the exit from the production. Money as part of the heat payment tariff, according to sectoral legislation, must:

In the first case, the money goes to the heat producer (Vekselberg), in the second case, it is invested in state-owned property (pipes, communications, distribution nodes). But the main thing is not even that.

Through leaky pipes in the Sverdlovsk region, about the same amount of heat goes into the atmosphere as it reaches the end consumer, payment for the entire volume takes place at the beginning of the journey, regardless of how many have reached the heating batteries!

Realizing this, Vekselberg imposed a complete ban on any communications service.

The maximum that is allowed to be done is emergency repairs with meager costs. They are made in violation of building codes and regulations and other regulatory guidelines.

In such a simple way, Viktor Vekselberg forced the residents of the Urals to pay for street heating and buy air.

The oligarch's firms reluctantly carry out only local "patched" repairs. They deliberately lay pipelines without thermal insulation, they do not adjust the hydraulic regime. The fact that major repairs are not carried out in principle, the reader probably already guessed.

In addition to logical conclusions, there are also irrefutable facts. So, in the Nizhneturinsky urban district, the work of the STK company was carried out exclusively emergency. At the same time, they were presented to the district administration as capital, false acts of work performed and forms KS-2 were submitted. On the website of the Arbitration Court of the Sverdlovsk Region, you can find a process initiated by the City Energy Service Company, which began transporting heat in Nizhnyaya Tura after the STK company finished its barbaric operation there. Even a cursory study of the case materials allows us to assess the damage that Viktor Vekselberg is causing to the economy. Judge for yourself:

For ten years from 2004 to 2014, STK did not adjust the hydraulic regime of networks, which led to an overestimated heat consumption so that it was enough for consumers;

Almost no major repairs and pressure testing of intra-quarter networks were carried out. Result: more than 170 emergency breaks of heat pipelines per year;

The volume of heat energy losses during transportation - over 50%!

This is just one city. And there are dozens of them!

The regions in which PJSC T Plus (IES-Holding) operates, in addition to the Sverdlovsk Region, are the Vladimir Region, the Ivanovo Region, the Kirov Region, the Republic of Mordovia, the Nizhny Novgorod Region, the Orenburg Region, the Penza Region, the Perm Region, the Samara Region, the Saratov Region , Udmurt Republic, Ulyanovsk region, Republic of Mari El, Chuvash Republic.

Structures affiliated to Vekselberg operate in the Republic of Buryatia, the Republic of Karelia, the Komi Republic, and the Amur Region.

Obviously, if in one small provincial town the damage to the state economy is 1 billion rubles, then over ten years of presence in 20 regions of Russia, the amounts amount to trillions. In light of all this, Vekselberg's activities in Russia reached the scale of a national catastrophe.

If you call a spade a spade, this is anti-state industrial sabotage. And possibly something much more.

In Nizhnyaya Tura, all funds collected from consumers were simply sent to the founder of STK, TGC-9. Now it is called differently - the Sverdlovsk branch of PJSC "T Plus".

Let me remind you: the tariff for heat payment involves not only the sale of services, but also the implementation of investment programs, capital and current repairs.

I note that the leaders of STK and T Plus are the same persons. They have a lot of practical experience and knowledge in the field of energy, so the deliberate intent in all this sabotage is obvious. These people know very well what they are doing.

What do we have in the dry residue?

Of course, I am not a judicial or investigative body, but I am not afraid to say that we are dealing with criminal scheme work of an organized group of people.

These are embezzlement on an especially large scale and the destruction of municipal, that is, state property. And this property ensures the vital activity of entire regions. These are factories, houses, hospitals, schools.

I am convinced that this is the activity of the enemies of the state, which falls under the Criminal Code of the Russian Federation. In addition to the destruction of public property, and enterprises due to alleged "losses" of the network organization. Means, in our receipts there is more than the amount for the rent, and at enterprises the cost of the product is more expensive.

By the way, Vekselberg's impact on the competitiveness of our enterprises is a separate issue. This is a real subversive work of an oligarch in the industrial heart of Russia.

Threat to national security

Everyone knows that Vekselberg was one of the founders and members of the board of directors of RUSAL and is a partner of Oleg Deripaska.

But few people know that Vekselberg had a direct influence on the closure of the Bogoslovsky aluminum plant (BAZ) in Krasnoturinsk.

It was he who owned the Bogoslovskaya CHPP, which provided energy for the city-forming enterprise and Krasnoturyinsk itself.

And BAZ in 2011-2012, in the face of falling aluminum prices and rising electricity prices, worked in the red: the production cost of 1 ton of metal reached $2,700, while world market prices were about $2,100. Electricity prices accounted for 40% of the prime cost. In 2011, the Ural plant bought electricity at 6.8 cents per 1 kW / h, while the Siberian enterprises of Rusal bought electricity at 3.4 cents.

Then Vladimir Putin, while in office as prime minister, initiated the sale of the thermal power plant to BAZ. However, this did not save the situation at the plant, as it turned out that the resource of the CHP was exhausted. You and I already know how Vekselberg exploits the energy industry and what his actual business practices are.

IES-Holding then undertook to build the Novo-Bogoslovskaya CHPP in Krasnoturinsk to provide heat supply to the city, but in the end it was decided to start a CHPP in the Akademichesky district of Yekaterinburg instead. There are higher margins. When asked to explain what the region's decision to postpone the construction of the Novo-Bogoslovskaya CHPP from Krasnoturinsk to Yekaterinburg was based on, Governor of the Sverdlovsk Region Evgeny Kuyvashev replied: purely on economic calculations.

As a result, devoid of cheap energy, Bogoslovsky aluminum plant was closed. My friends and readers from Krasnoturinsk tell me: the anti-state articles of the white-tape publications that opened there began to fall like fertile seeds on the depression, unemployment and lack of money that reigned in the city.

Of course, they are skillfully projecting the blame for what is happening (devastation, rising tariffs, unemployment) onto the incumbent President. It is with the help of such a destabilization of society that color revolutions are being prepared.

Today "T Plus", sweeping away other service companies in the region, eager to operate networks in the Closed Administrative-Territorial Formation "Forest" in the north of the Sverdlovsk region.

There is isotope fission plant, filling for "Yars" is produced. The promotion of Vekselberg's company to the closed city is supported by the Prime Minister of the Sverdlovsk Region Denis Pasler.

Does the Sverdlovsk prime minister know what a disservice he will render to Russia? I hope no. In any case, my investigation will help to understand the issue and take a position that is in line with the interests of the Motherland.

We have clearly seen that the work of Vekselberg's structures leads to the destruction of the economy of cities and the shutdown of factories. In the case of Lesnoy, the arrival of T Plus there is a threat to the national security of the Russian Federation. But more on that in the next article.

At the same time, for example, Fullerton Marketing Limited, according to the list of affiliates, has the right to dispose of more than 20% of the shares, which for some reason is not mentioned on the official page of PJSC T Plus. That is, at least 64.37% of PJSC T Plus is owned by foreign companies.

“We are not even discussing it yet. Not yet. We don't think it's time (to return to the stock exchange)," Pasler told reporters on Thursday.

Pasler, who previously headed the government of the Sverdlovsk region, last March became acting CEO of the energy holding Vekselberg, whose managers are under house arrest in connection with a 2016 investigation of bribery in Komi.

Vekselberg reorganized the energy business in 2014, consolidating the generating and marketing assets of the holding's IES on the basis of Volzhskaya TGC (now T Plus).

The energy holding with power plants of 16.2 gigawatts ranks fifth in Russia in terms of electric installed capacity and first in terms of heat. At the end of 2016, the company left the Moscow Exchange.

Now Vekselberg and structures friendly to him have 76.72% of shares, 15.08% - from minority shareholders, another 8.2% - a treasury stake.

According to Pasler, the controlling shareholder is not going to buy out the shares of minority shareholders, and those who did not show interest in selling the shares.

Pasler also said that the holding will not pay dividends for 2017 and 2018 as the amount of investment required is still high. The company plans capital investments of 25 billion rubles this year, in addition, it has to spend 10 billion rubles on the construction of solar power plants.

“The desire of the shareholders is there, but with such huge investment programs, it is not easy to do... As long as the strategy includes the construction and development of new power plants, there are no payments yet,” Pasler said.

In November last year, in a presentation to investors for debut bonds, T Plus, referring to the current dividend policy, wrote that achieving a debt-to-EBITDA ratio of 3.5 makes it possible to form dividend payments.

According to the top manager of the energy holding, the ratio of debt to EBITDA by the end of 2017 decreased to 3.1x from 3.8x a year earlier. The debt is currently valued at 134 billion rubles, compared with about 147 billion rubles at the beginning of the year, he said.

Pasler said the holding wants to participate in a new competition for green generation, which will be held in June, planning to apply for the construction of solar generation.

At this competition, it is planned to distribute 830 megawatts for the construction of wind turbines, 270 megawatts for small hydroelectric power plants and 150 megawatts for generation based on solar energy.

T Plus intends to participate in the upcoming tender for the modernization of existing power plants and hopes that the first auction will start this year.

Pasler estimated the volume of possible modernization of the company at 2.5-3 gigawatts with investments of 60-90 billion rubles.
