1. Requirements for expert technicians performing an independent technical examination of vehicles, including the requirements for their professional certification, the grounds for its cancellation (hereinafter referred to as the Requirements) are developed in accordance with paragraph 4 of Article 12.1 of the Federal Law of April 25, 2002 N 40- Federal Law "On Compulsory Civil Liability Insurance of Vehicle Owners" and Clause 1 of the Decree of the Government of the Russian Federation of October 17, 2014 N 1065 "On the determination of authorized federal executive bodies that establish requirements for expert technicians, including requirements for their professional certification, the grounds for its cancellation, as well as the procedure for maintaining the state register of expert technicians, and for recognizing as invalid some decisions of the Government of the Russian Federation. 2. Requirements establish requirements for knowledge, skills and level vocational education expert technicians, as well as the requirements for their professional certification and the grounds for its cancellation.

3. Professional certification of expert technicians (hereinafter - professional certification) is carried out in order to confirm the necessary knowledge and skills of a candidate for expert technicians (hereinafter - candidate) for the implementation of an independent technical examination of vehicles and the subsequent inclusion of information about the expert technician in the state register of experts -technicians in accordance with the procedure approved by order of the Ministry of Justice of Russia dated February 6, 2013 N 8 "On approval of the Procedure for maintaining the state register of expert technicians" (registered by the Ministry of Justice of Russia on February 14, 2013, registration N 27071) (hereinafter - order of the Ministry of Justice of Russia N 8 ).

4. Professional certification is carried out by the Interdepartmental Certification Commission (hereinafter - IAC). The composition of the IAC is approved by the Minister of Transport of the Russian Federation.

5. The IAC is formed by representatives of the Ministry of Transport of Russia, the Ministry of Justice of Russia, the Ministry of Internal Affairs of Russia, as well as public organizations and experts in the field of independent technical examination of vehicles.

6. The expert technician should know:

federal laws and other regulatory legal acts of the Russian Federation in the field of civil liability insurance of vehicle owners, independent technical examination of a vehicle, road safety, including:

Regulation of the Central Bank of the Russian Federation of September 19, 2014 N 433-P "On the rules for conducting an independent technical examination of a vehicle" (registered by the Ministry of Justice of Russia on October 1, 2014, registration N 34212) (hereinafter - the Rules for conducting an independent technical examination);

A unified methodology for determining the amount of expenses for refurbishment in relation to a damaged vehicle, approved by the Regulation of the Central Bank of the Russian Federation of September 19, 2014 N 432-P "On a unified method for determining the amount of expenses for refurbishment in relation to a damaged vehicle" (registered by the Ministry of Justice of Russia 3 October 2014, registration N 34245) (hereinafter - the Unified Methodology);

research methods to establish the volume and nature of damage to a vehicle and the causes of their occurrence;

methods of vehicle identification and verification of the reliability of identification parameters;

fundamentals of technical operation of vehicles;

types, nature and classification of damage to vehicles in road traffic accidents;

main types, classification and design of vehicles, their main units, assemblies and systems;

vehicle restoration technology;

nomenclature of structural and operational materials used in the automotive industry, during the operation and repair of vehicles;

measurement methods, design of measuring instruments and rules for their use in diagnosing vehicles;

methods of conducting statistical observations and processing their results;

methods for establishing the average cost of an analogue of a vehicle according to the available information and reference materials, in order to determine its pre-accident cost;

methods of determining the usable remains of vehicles and determining their value;

methodology for the use of information databases and software and computational systems used in independent technical expertise.

7. An expert technician should be able to:

use measuring instruments used in diagnosing and repairing vehicles;

carry out photo and video filming of vehicles;

to record the presence, type, nature, volume (degree) of damage to parts (assemblies, assemblies) and systems of the vehicle, to establish the necessary methods, technologies for their restoration and to determine the labor intensity of the necessary work;

to calculate replacement costs using software and calculation systems;

draw up documentation in accordance with the Rules for conducting an independent technical examination.

8. An expert technician must meet one of the following vocational education requirements:

have a higher education in the areas of training, specialties included in the enlarged groups of areas of training, specialties "Engineering and technology of ground transport" and additional professional education under the advanced training program in the field of independent technical examination of vehicles;

have a higher education and additional professional education under the professional retraining program in the field of independent technical examination of vehicles.

9. The candidate for passing professional certification sends to the Federal state-financed organization"Agency of Automobile Transport" (or its branches located at the addresses published on the official website www.rosavtotransport.ru in the information and telecommunication network "Internet") (hereinafter - FBU "Rosavtotrans"), which provides organizational and technical support for the work of the IAC, a statement v free form on the passage of professional certification with the attachment of the following documents (copies):

registration card of a candidate for technical experts carrying out an independent technical examination of vehicles (hereinafter - registration card) (annex to these Requirements);

copies of documents on education and qualifications with attachments confirming the presence of higher education;

copies of qualification documents with appendices confirming the improvement or conferment of qualifications based on the results of obtaining additional vocational education, in accordance with paragraph 8 of these Requirements;

a copy of the work book (if any);

two photographs measuring 4x6 cm;

list of submitted documents.

Documents must be submitted on paper as well as electronic media.

Copies of the submitted documents are certified in accordance with the established procedure.

10. In the application for passing the professional certification, the candidate shall indicate:

surname, first name and patronymic (the latter, if any);

residence address;

data of the identity document;

phone number;

mailing address;

address Email;

the candidate's consent to the processing of personal data;

date of drawing up the application.

The application is signed by the candidate.

11. On the day of receipt of the application, FBU "Rosavtotrans" registers the application and checks the presence of all required documents for compliance with the list given in clause 9 of these Requirements.

12. After three working days from the date of verification of documents in order to confirm the necessary knowledge and skills, FBU "Rosavtotrans" sends the candidate a test task to the e-mail specified in the application, and in the absence of e-mail - to the postal address by letter with acknowledgment of receipt.

13. The test task should include a condition for drawing up expert opinion in the field of independent technical examination of vehicles in one of the categories (L, M, N) established by Appendix No. 1 to the technical regulation of the Customs Union "On the safety of wheeled vehicles", photos and other materials containing information necessary for drawing up an expert opinion in the field of independent technical examination of vehicles that meets the Unified Methodology, as well as control questions.

14. The number of options and the content of control tasks are approved by the decision of the IAC.

15. The candidate submits the completed test task at the place of filing the application within a period not exceeding twenty one calendar days from the date he received the specified test task.

16. FBU "Rosavtotrans" sends copies of the documents specified in clause 9 of the Requirements and a copy of the completed control task for consideration to the IAC members within a period not exceeding five working days from the date the candidate submits the completed control task.

17. The IAC examines the documents and makes a decision on professional certification or failure to pass professional certification within a period not exceeding forty-five working days from the date the candidate submits the completed test task to FBU "Rosavtotrans".

18. State forensic experts certified in the relevant expert specialty are included in the state register of expert technicians in the manner prescribed by order of the Ministry of Justice of Russia No. 8. Information on the certification of state forensic experts entered in the state register is included in the minutes of the next meeting of the IAC.

20. The IAC decides on the failure to pass professional certification on the following grounds:

non-compliance of the candidate with the requirements specified in clause 8 of these Requirements;

absence or improper execution of the documents specified in clause 9 of these Requirements;

non-fulfillment or fulfillment of a control task, the results of which do not comply with the Rules for Conducting an Independent Technical Expertise and the Unified Methodology.

The decision on failure to pass professional certification must contain an indication of the basis for its adoption.

21. The IAC decides to cancel the professional certification of an expert technician on the following grounds:

establishment of the fact that an expert technician has submitted false information when he passes professional certification;

death of the expert technician, as well as the recognition of the expert technician as incompetent, missing, declaring dead on the basis of a court decision that entered into legal force;

repeated (two or more) violations of the requirements of regulatory legal acts regulating activities in the field of independent technical examination of vehicles, which led to an excess of the limit of statistical reliability of the examination results established by paragraph 3.5 of the Unified Methodology;

submission by an expert technician of an application for the cancellation of his professional certification.

22. The candidate (expert technician) is informed about the decisions made by the IAC in writing or in the form of an electronic document by sending a notification to the e-mail address within a period not exceeding fifteen working days from the date of the relevant decision.

23. An expert technician, in respect of whom a decision has been made to cancel his professional certification, with the exception of the cases specified in the third paragraph of clause 21 of these Requirements, has the right to reapply for professional certification at Rosavtotrans no earlier than after 6 months from the date of cancellation of professional certification.

24. The candidate (expert technician) has the right to appeal against the decision on the failure to pass the professional certification (to cancel the professional certification) within two months from the date of the relevant decision. The IAC considers the complaint within a period not exceeding ninety calendar days, with the personal participation of the candidate (expert technician).

25. Decisions on professional certification, on failure to pass professional certification, cancellation of professional certification are made at the IAC meeting and are drawn up in the minutes of the IAC meeting (hereinafter referred to as the minutes). The protocol is drawn up in triplicate. The first copy of the protocol together with the registration card is sent within fifteen working days from the date of the professional certification of the candidate to the Ministry of Justice of Russia, the second copy is kept at the Ministry of Transport of Russia, the third copy is kept at the IAC secretariat.

26. Copies of the protocols are posted on the official websites of the Ministry of Transport of Russia: www.mintrans.ru and FBU "Rosavtotrans": www.rosavtotransport.ru in the information and telecommunications network "Internet".

Conditions and procedure for professional certification of expert technicians who carry out independent technical expertise of vehicles, including requirements for expert technicians

I. General Provisions

1. These Conditions and the procedure for professional certification of expert technicians who carry out independent technical expertise of vehicles, including the requirements for expert technicians (hereinafter referred to as the Procedure) are developed in accordance with Federal Law No. 40-FZ of April 25, 2002 "On compulsory insurance of civil liability of vehicle owners "* and the Decree of the Government of the Russian Federation of April 24, 2003 N 238" On the organization of independent technical examination of vehicles "**.

2. Professional certification of expert technicians performing independent technical examination of vehicles (hereinafter - professional certification) is carried out in order to confirm the qualification skills and knowledge of a candidate for expert technicians for carrying out work on an independent technical examination of vehicles and inclusion in the state register of experts - technicians in accordance with the procedure approved by the order of the Ministry of Justice of Russia dated July 30, 2003 N 155 "On approval of the procedure for maintaining the state register of expert technicians" (registered by the Ministry of Justice of Russia on July 7, 2003, registration N 4873).

3. Professional certification is carried out by the Interdepartmental Certification Commission (hereinafter - IAC).

4. The following are admitted to professional certification:

1) specialists with higher education who have at least 1 year of experience in the field of examination of vehicles to establish the presence, causes and nature of technical damage to a vehicle, as well as the technology, volume and cost of its repair and who have completed at least 5 conclusions (reports) in the specified area;

2) other persons who have higher education and have undergone special training in educational programs for professional retraining and advanced training of expert technicians.

5. Decisions on certification of state forensic experts who have undergone professional retraining and advanced training in educational programs for professional retraining and advanced training of expert technicians and certification in the manner prescribed by regulatory legal acts of the relevant federal executive bodies are sent to the Ministry of Justice of Russia to include state forensic experts to the state register of expert technicians.

II. Documents Submitted by a Candidate for Technician Experts for Professional Certification

6. To pass professional certification, a candidate for technical experts shall submit the following documents:

application for passing professional certification according to the sample (annex to this Procedure);

the registration card of the expert technician, which must be filled in in printed text or in legible handwriting and signed with his own hand (the form of the registration card is given in Appendix No. 2 to Order No. 155 of the Ministry of Justice of Russia dated June 30, 2003);

copies of documents on education, including on professional retraining and advanced training of an expert technician;

a copy of the work book;

documents confirming state registration an individual entrepreneur or organization that is the main place of work of a candidate for technical experts;

two photographs measuring 4x6 cm;

a certificate confirming at least 1 year of work experience, and copies of at least 5 conclusions (reports) (for the specialists specified in subparagraph 1 of paragraph 4 of this Procedure) (when checking the information, the originals of these reports may be requested);

copies of other documents confirming the availability of special knowledge;

list of submitted documents in 2 copies.

All copies of the submitted documents must be certified in accordance with the established procedure.

III. Professional Technician Requirements

7. The expert technician must have specialized knowledge, including:

federal laws and regulatory legal acts of the Russian Federation on compulsory civil liability insurance of vehicle owners, expertise and expert activities in transport;

research methods to establish the presence, causes and nature of technical damage to a vehicle, as well as the technology, volume and cost of its repair, based on the use of electronic information and analytical systems, professional databases, software and hardware systems, as well as other methodological and information and reference documents;

types of vehicles, their classification and design;

vehicle identification methods;

types, nature and classification of damage to vehicles in road traffic accidents;

rules and regulations of labor protection, safety, industrial sanitation and fire protection.

8. Experts-technicians, certified in the specialty in the field of examination of vehicles to establish the presence, causes and nature of technical damage to a vehicle, as well as the technology, volume and cost of its repair, undergo advanced training once every five years.

IV. Professional certification procedure

9. The documents submitted by the candidate for expert technicians (hereinafter referred to as the candidate) in accordance with the requirements specified in Section II of this Procedure, and verified by the IAC, are the basis for considering the issue of professional certification and assignment of the qualification "expert technician".

10. To study the documents submitted by a candidate for professional certification, the IAC has the right to involve authorized organizations of the federal executive authorities, whose representatives are part of the IAC.

11. The documents submitted by the candidate for professional certification in the IAC are considered within a period of not more than 1 month from the date of receipt of the documents.

12. The date of receipt of documents is the date of their registration with the IAC.

13. In case of submission of documents in incomplete volume or inadequately executed, they are returned to the candidate within 15 working days from the date of receipt by the IAC.

14. During the meeting, the IAC examines the materials submitted for its consideration and, if necessary, invites the candidate for an interview on a specific expert specialty, theoretical foundations technical expertise, the norms of the legislation of the Russian Federation and normative legal acts of federal executive bodies regulating expert activities, after which he assesses the level of his special knowledge.

15. The candidate in respect of whom the question of professional certification is being decided is not present during the voting.

16. When making a decision to refuse professional certification, the IAC informs the candidate of a reasoned refusal in writing.

17. Candidates have the right to appeal the results of the professional attestation.

18. The candidate must be notified of the decisions of the IAC in writing no later than 15 days after the professional certification.

19. The decision on professional certification of a candidate is drawn up in a protocol. The protocol is drawn up in triplicate. The first copy of the protocol, together with the registration card, is sent to the Ministry of Justice of Russia for further inclusion in the state register of expert technicians, the second copy remains in the IAC and is attached to the candidate's file, the third copy is sent to the candidate.

Meeting of the Interdepartmental Attestation Commission for the professional attestation of expert technicians on May 23, 2012, the Ministry of Transport of Russia.

A meeting of the Interdepartmental Attestation Commission (IAC) was held at the Ministry of Transport of the Russian Federation to conduct professional attestation of expert technicians who carry out independent technical expertise of vehicles.

The meeting was opened by the Deputy Minister of Transport of the Russian Federation, Chairman of the IAC - Asaul N.A.
The Deputy Minister of Transport of the Russian Federation informed the members of the commission about the course of the professional certification of expert technicians. In his speech, he noted that currently 246 applications from candidates for professional certification of expert technicians have been received. 6 candidates have successfully passed the certification, the rest of the candidates' applications are being worked out today. Many submitted documents do not yet meet the requirements.

The representative of the Ministry of Justice of Russia informed the members of the commission that 6 experts have already been included in the state register. Forms of documents for professional certification are currently in production, it will take some time. The form will have many degrees of protection. After the production of the forms, their issuance will begin.

The Chairman of the IAC gave the floor to the Chairman of the All-Russian Trade Union of employees of audit, appraisal, expert and consulting organizations - Piskurev V.V.

In his speech, the Chairman of the Trade Union criticized the work of the IAC for "delaying" the deadlines for considering applications, pointed out the inadmissibility of refusal to certify workers (expert technicians) on grounds if the employee's work record does not indicate the profession of expert technician.

The Chairman of the Trade Union informed the members of the commission that today the unified qualification directory contains the following specialties, which are in no way related to each other, these are specialties: appraiser, expert, technician, expert auto technician.

A unified qualification reference book for these specialties makes various requirements, often not related to each other. An employee cannot be held liable for the state if the state has not yet approved the profession of an expert-car technician and has not approved and developed a professional standard in the direction of an expert-car technician.

In his speech, Vladimir Piskurev harshly demanded that the commission members and representatives of the Ministry of Transport accelerate the adoption of a regulatory document by the Ministry of Transport of Russia on the regulation of the requirement for a conclusion and the development of a standard standard expert opinion.

The Chairman of the Trade Union stated that, in accordance with the requirements of labor law, the certification of workers (expert technicians) should be carried out in the presence and with the participation of trade union bodies in order to prevent infringement of the rights of workers and members of the Trade Union.

Deputy Minister of Internal Affairs of the Russian Federation, Police Colonel-General Viktor Kiryanov, after criticizing the Trade Union against the IAC, expressed the opinion that “the certification of workers should be carried out in accordance with the norms of the Labor Code of the Russian Federation; when certifying workers, it is necessary to take into account the opinion of the All-Russian Trade Union. This is a normal practice of labor relations in our country, ”said Viktor Kiryanov.

In his speech, the Chairman of the Trade Union V.V. Piskurev drew the attention of the IAC members to the Decree of the President of the Russian Federation V.V. Putin "On measures for the implementation of state policy in the field of education and science" No. 599 of May 7, 2012 and Presidential Decree "On measures for the implementation of state social policy" No. 597 of May 7, 2012, which instructed the Government of the Russian Federation together with All-Russian associations of employers and leading universities with the involvement of scientists from the Russian Academy of Sciences and international experts to submit proposals for public and professional accreditation in December 2014 educational programs higher professional education and approve by December 1, 2012 a plan for the development of professional standards and develop by 2015 and approve at least 800 professional standards. This also applies to professional standards in the field of expert technicians, noted Vladimir Piskurev.

The Chairman of the Trade Union proposed to the IAC members, given that an appraiser, an expert, a technician and an expert-auto technician are different professions, to form a working group to prepare a professional standard for the specialty expert-technician and develop requirements for the profession of an expert-technician. The members of the IAC unanimously approved the proposal of the Trade Union.

Igor Vadimovich Titov, Head of the Research Institute of Automobile Transport, expressed an opinion on the need to develop uniform requirements and approaches in the specialty of an expert technician “Today, taking into account the requirements of the legislation, it is impossible to arrange“ profanity ”with the certification of expert technicians. It is impossible for “random people” to appear in the examination, noted Igor Titov.

The participants expressed the opinion that today, unfortunately, a diploma of education can be bought in “any underground passage”. Piskurev noted: “Considering the numerous appeals of the territorial bodies of the Trade Union and discrepancies in the regulatory documents regulating the professions of experts, technicians, expert auto technicians, appraisers, the Trade Union takes responsibility and sets itself the task of submitting to the IAC for consideration expert comments, petitions and recommendations for each of its members who have submitted applications for certification in the IAC and will ask IAC members to consider, first of all, the documents of candidates who have passed preliminary studies and received the approvals and petitions of the Trade Union. "

The Chairman of the Trade Union noted that this function of lobbying the interests of the members of the Trade Union is one of the main functions of the Trade Union, spelled out in federal legislation. Today, apart from the Trade Union, we do not have a single all-Russian organization uniting expert technicians.

“If the Trade Union takes responsibility and writes a petition to the IAC, then the Trade Union takes on the functions of a social guarantor for each of its members who have passed certification by the IAC. We take responsibility for the fact that the diplomas of our members are not bought in "underground passages", and each member of our Trade Union, who has applied to the IAC, has the appropriate professional training in the field of examination of vehicles "- said V.V. Based on the results of the meeting of the Interdepartmental Attestation Commission for the professional attestation of expert technicians, a working group for interaction with the IAC was formed in the Executive Committee of the Trade Union. I. General Provisions

1. II. Tasks and functions of the IAC

3. Within the framework of the activities carried out, the IAC is assigned the following tasks:

professional certification of expert technicians;

cancellation of professional certification of expert technicians.

4. The IAC, in order to solve the tasks assigned to it, carries out the following functions:

development and approval of control tasks for professional certification;

preparation of proposals for the organization and conduct of certification of expert technicians;

assessment of the compliance of the qualifications of candidates for technical experts with the requirements established by the legislation of the Russian Federation;

making decisions on professional certification of expert technicians or not passing the professional certification of expert technicians;

making decisions on cancellation of professional certification of expert technicians;

preparation of proposals for improving the educational and methodological base in the field of training and knowledge assessment of expert technicians;

ensuring the publicity of the results of IAC meetings;

consideration of complaints against decisions of the IAC, as well as on the activities of expert technicians.

III. Composition and organization of IAC activities

5. The IAC is formed in the composition of the chairman, deputy chairman, secretary and members of the IAC.

6. Chairman of the IAC:

manages the work of the IAC;

appoints the date of the IAC;

holds IAC meetings and announces its results;

gives instructions to the members of the IAC and the secretary related to the activities of the IAC;

approves the list of checklists for professional certification.

In the absence of the Chairman of the IAC, his duties are performed by the Deputy Chairman of the IAC.

IAC members:

are directly involved in the certification;

prepare proposals for optimizing the work of the IAC;

participate in the discussion and decision-making on the work of the IAC;

carry out the instructions of the chairman of the IAC.

IAC Secretary:

keeps minutes of IAC meetings;

provides work on preparation for IAC meetings;

carries out the instructions of the chairman of the IAC.

The organizational and technical support of the IAC activities is carried out by the federal budgetary institution "Agency for Automobile Transport" (hereinafter - FBU "Rosavtotrans"), which:

accepts and registers applications from candidates and attached documents;

conducts office work of the IAC;

maintains a consolidated register of IAC protocols;

publishes information on the composition of the IAC and the minutes of IAC meetings on the official website of FBU "Rosavtotrans" in the information and telecommunication network "Internet".

7. The work of the IAC is carried out on the basis of plans considered at its meeting and approved by the chairman of the IAC. As a rule, IAC meetings are held at least once a month.

8. A meeting of the IAC is considered competent if at least half of the members of the IAC are present. It is allowed to participate in the meeting of the IAC members via video communication. Decisions are taken by a simple majority of votes of the total composition of the IAC members present at the meeting and are drawn up in the minutes. It is allowed to represent the interests of a member of the IAC at a meeting by a person who has an appropriate power of attorney from a member of the IAC, made in a simple written form. The minutes are signed by the presiding officer in triplicate. The first copy of the protocol, together with the registration card, is sent to the Ministry of Justice of the Russian Federation, the second copy is kept at the Ministry of Transport of the Russian Federation, the third copy is kept at the FBU "Rosavtotrans" in the IAC secretariat.

9. Applications are submitted by a candidate to FBU "Rosavtotrans" or its branches. Subject to the availability of all the necessary documents stipulated by the Requirements, FBU "Rosavtotrans" or its branches, within three days, sends the candidate a test task to the e-mail specified in the application, and in the absence of e-mail - to the postal address.

In case of submission of documents in an incomplete volume or improperly executed, the candidate is notified to the e-mail address indicated in the application, and in the absence of e-mail, to the postal address, of the refusal to register documents for consideration at the IAC meeting.

At the written request of the candidate, the documents are returned for revision.

10. FBU "Rosavtotrans" sends the IAC members within five days the documents submitted by the candidate, after receiving the test task completed by the candidate. The documents are accompanied by a review of the control task, performed by an expert of FBU "Rosavtotrans".

11. Members of the IAC, at least two days before the meeting of the IAC, submit information on the results of the consideration of candidates' documents and test assignments to the IAC Secretariat.

12. FBU "Rosavtotrans" prepares a summary report on the candidates considered at the IAC meeting, taking into account the opinion of all IAC members.

13. The IAC considers the documents of the candidates and makes a decision within a period not exceeding forty-five working days from the date the candidate submits the completed test task to the FBU "Rosavtotrans".

IV. Handling complaints

14. Complaints about decisions of the IAC, as well as about the activities of expert technicians are filed with FBU "Rosavtotrans" or its branches.

15. FBU "Rosavtotrans" sends a complaint to the IAC members within five days.

16. Members of the IAC within two weeks prepare proposals on the complaint. If additional information is required, FBU "Rosavtotrans" within a week after receiving proposals on the complaint from the IAC members sends relevant inquiries.

17. Additional information is considered by the IAC members within the time frames provided for in clauses 15 and 16 of these Regulations.

18. Consideration of a complaint against a decision on failure to pass professional certification (on cancellation of professional certification) is carried out by the IAC within a period not exceeding 90 calendar days, with the personal participation of the candidate.

19. Complaints about the activities of expert technicians are considered by the IAC members within 30 days from the date of registration of the written application, and in cases of additional inquiries, the consideration of the application is extended for no more than 30 days, notifying the extension of the term for its consideration of the citizen who sent the application.
