How to get a land plot from the state for free

Federal Law of October 25, 2001 N 137-FZ "On the Enactment of the Land Code of the Russian Federation" interprets that every citizen of the Russian Federation has the opportunity to register state land for free for farming, farming, as well as for building residential buildings. You will only need to pay for the paperwork, for example, the cadastral number.

But practice shows that in fact it is quite difficult to achieve a positive result in this matter, but it is still possible if you know and take into account all the nuances.

The procedure for obtaining state land

If you want to receive a free land plot from the state, then correct and clear actions are required from you:

  1. Find an empty land plot no one needs without a cadastral passport... To obtain accurate information about the presence or absence of the latter, find a map (cadastral) of Russia, where you can check if someone has ownership rights to the land you have chosen. You can also contact the land surveyor. On request, he will give you a certificate indicating the absence of the owner and built houses on the site. Keep in mind that it is much easier to get a land plot away from big cities. Choose a site in a residential area, with the presence of communications, since no one will conduct them to you. Self-connection will be very expensive. In this case, it is easier to buy land with all the amenities at your own expense.
  2. We contact the municipality. After you find out which region and district the plot you want to receive belongs to, you need to go to the local municipality with an application for a request to allocate land. In the department for the distribution of land holdings, write a statement (be sure to indicate the purpose) with a request to allocate land to you. You will then be directed to surveyors and cadastral number specialists. You will have to cover such costs yourself, but still it will not cost as much as buying a plot.
  3. Passage of the auction.

The auction is held in stages:

  • After the written statement in the newspaper (state) there is a notice of a free site, which is put up for auction. Those who wish have the right to participate.
  • If there are still interested persons, then you will have to bargain, but there are cases when the price of this land jumps or even leaps over the market price. In this case, it is better to abandon the acquisition of this particular allotment and look for another.
  • More often than not, no one else claims to "your" land, so you just buy it out for a very small amount.
  • We get approval and build your dream home.

If you have already received the "conclusion", then take all the necessary documents (about the purchase) and go to the local administration for registration of ownership of land real estate.

After receiving all the necessary documents, you can start construction. But do not forget that you are the tenant at the time of construction. If a house or something else has not been erected within the established time frame, the rent will be doubled.

Which plots are plots of actual use

The land plots, which are called actual use, include:

  • Detached areas.
  • Detached lands.
  • Allotments on which there are buildings. At the same time, a citizen can use it for an indefinite period or for life, as well as transfer it by inheritance or will free of charge.

If you need to register ownership of a plot that you practically use, then you should leave a statement with the local authorities indicating a request to obtain an official title to this land plot. The only thing that you will need to pay for is the fees provided for by the legislative acts of Russia.

Detached plots

These include plots of land with buildings of houses, which citizens began to use before the laws on private property in the USSR were adopted. Even if you do not have documents that prove the right of ownership (and more often than not, it is), you can easily register the land as your own.

Detached lands

Such plots are called those that were provided to people for life-long use or for an indefinite period, while retaining the right to transfer them to their heirs. Citizens received separate plots from the administration. Confirmation of the allotments are the adopted resolutions.

With the presence of such a document, you can easily re-register the land to yourself for free. But it should be borne in mind that you can get land in this way only once. That is, if a person previously used such land for free, then he no longer has the right. For repeated and subsequent exploitation of land real estate, you will need to pay a certain amount (in accordance with the law).

Building plot

In case of presence of buildings on self-occupied land, you need to contact the local municipality with an application. After that, you will need to issue a cadastral passport (of course, at your own expense). Local authorities will provide a document certifying that you have received a land plot free of charge.

Basic schemes for the legal receipt of a land plot

There are several schemes by which you can get land. In principle, they are the same for all residents of Russia, but in different regions the legal schemes have their own characteristics. Therefore, somewhere, for example, in the Novosibirsk region, it is quite easy to get a plot, but in the Moscow region, on the contrary, it is very difficult and time-consuming.

There are two options for obtaining land:

  • self-seizure of a piece of land that is not occupied by anyone;
  • participation in the auction.

Before dwelling on any of the presented schemes, you need to think about which option will be suitable for a particular region. In order to find out how to obtain a land plot at the desired point on the territory of Russia, you can obtain information from the institution of the local administration.

Win an auction

The auction option is more efficient and not as risky as taking over on your own. It is not difficult to win an auction and receive land from the state, since often no one is interested in this site anymore. More details on the procedure for obtaining a land plot will be further in our article.

Self-capture

In Russia, as in any other country, there are empty lands. If the site is empty, has not been processed by anyone for more than several years (each of the regions has its own established terms, it can be from 3 years to 10) and there are no other applicants for it, then you can seize the site yourself. After that, issue it to yourself.

In this case, it is necessary to obtain the appropriate permission from the local authorities. Your application will be reviewed by a special commission. After the commission allows you to obtain ownership on a free basis, you can begin to make geodetic measurements and draw up a passport (cadastral).

Do not forget that self-seizure of land is rather risky, because:

  • Years later, the owner of the site or his heirs may appear. In this case, you will have to sue, and it is not a fact that the case will be won.
  • The authorities may refuse to register the property, as the land may be designated for agricultural work.

Preferential categories of people

Each region of the Russian Federation has its own rights to obtain land property, and the list of privileged groups of people is also different. The most indulgent towards the needy is the Novosibirsk region. The list is very wide there.

Consider the main list of groups of beneficiaries:

  1. WWII veterans and participants in hot spots, as well as members of their families who have lost their ability to work. The law adopted in 1995 stipulates that people belonging to this category can receive land for buildings, orchards, vegetable gardens, pastures and hayfields;
  2. Servicemen. The contract must be between 10 and 15 years. Such beneficiaries have the right to receive land for building a house and running a household. The current law "On the status of military personnel" is allowed to receive free plots in the area where the service lasts. The military, who no longer serve (this is due to age characteristics, health status or reduction), have similar rights. Length of service - at least 15 years;
  3. Police officers. Those persons who have served in the police department for at least 15 years. This category of people has the right to receive land plots from the state: in the city - no more than 0.06 hectares, within villages - 0.1 hectares, in rural areas - 0.25 hectares.

The police officers (pensioners) and their families who have serious illnesses or injuries also have this right. And also those families whose police officer died in the line of duty;

The right to free land is granted:

  1. Chernobyl victims who received radioactive exposure.
  2. Heroes of social labor, holders of the Order of Labor Glory.
  3. Needy citizens who are registered.
  4. Orphans are given the right to register their parents 'or relatives' land for free.
  5. Families where children are brought up who have not reached the age of majority, large families, and also with one parent.
  6. Government employees working on a contract basis.
  7. Specialists (under the age of 35) with secondary or higher education, while working in rural areas in their profession, can get a plot there. The preferential categories include:
    • Healthcare sector.
    • Agriculture.
    • Education and culture.

The following documents will be required:

  • passport;
  • certificate of the availability of benefits;
  • a document that confirms that the person has not previously used state land free of charge (extract from the state register);
  • write a corresponding statement.

After that, you will be put on the waiting list for receiving land. But no one knows how long they will have to wait for their turn.

Almost free land-long-term lease agreement

Another proven way to obtain land from the state on a free basis is to lease for a long time. The leased plot can be used for 49 years, after which it is extended if necessary. Due to the long lease terms, it has been used by more than one generation. The cost of such a service is quite low.

What a young family needs to get free land

The state of the Russian Federation provides for the receipt of a plot for a family (young). This is considered a family whose spouses (both) are not more than 35 years old.

You will need to do the following:

  • Confirm with special documents (certificates) that you need to improve living conditions. Unless, of course, the square meters of living space per family member is less than it should be.
  • Then go to the local administration to queue up to receive the site.
  • Wait for notification.
  • Take a good look at the proposed allotment.
  • Start building a house and then you can take ownership.

You will only need to pay for the paperwork, the funds for laying communications are taken from the city budget.

Conclusion

Remember that every citizen of the country has the right to receive a land plot for free , but this is not always easy and simple. A positive result depends only on the correctness of your actions, knowledge of the legal framework, determination and desire.
