Appendix 1. Regulations on the procedure for the design and construction of garage facilities in the city of Moscow

I. General Provisions

This Regulation was developed on the basis of the Civil Code of the Russian Federation, the Land Code of the Russian Federation, the Town Planning Code of the Russian Federation, legislative and other regulatory legal acts Russian Federation and the city of Moscow.

The main goal is to organize the mass construction of garage facilities by introducing a co-financing mechanism (funds from the budget of the city of Moscow, citizens and investors) and providing land plots in accordance with the requirements of federal legislation, ensuring the availability of construction, purchasing parking spaces, taking into account the registration of ownership rights to participants in shared construction.

II. Terms and their interpretation

1. Organized storage facilities for vehicles - objects of capital construction for garage purposes for the placement of storage facilities for vehicles located at the place of residence of car owners may be owned or leased to individuals and legal entities.

2. Organized parking places for vehicles - objects of capital construction for garage purposes, which are infrastructure facilities for temporary placement of cars, are not the property of car owners; are provided to individuals on a per-hour basis or free of charge, provided that the intended use is preserved.

3. Objects of garage designation in complex residential development - stand-alone objects of capital construction of garage designation, intended for organized storage of vehicles, erected simultaneously with residential properties as part of blocks of mass development and complex reconstruction.

4. Compensation objects for garage purposes - objects of capital construction for garage purposes, intended for the organized storage of vehicles, being built to replace the demolished places of temporary storage of vehicles in order to release land plots for urban needs.

5. Objects of garage designation at the location of "flat" parking lots - objects of capital construction of garage designation, intended for organized storage of vehicles, built on land plots occupied by temporary "flat" parking lots.

6. Competitive objects for garage purposes - stand-alone objects of capital construction for garage purposes, intended for organized storage of vehicles, being built on the formed land plots taken out to land auctions with the right to conclude a lease agreement for a land plot for capital construction purposes.

7. Commercial objects in which organized storage areas for cars are located - built-in and attached objects of capital construction for garage purposes, intended for organized permanent storage of vehicles, the construction of which is technologically connected with the construction of residential buildings.

8. Transport interchange hubs (TPU) - objects of capital construction for garage purposes, located as part of the nodal elements of the planning structure of the city of transport and public purposes, in which passengers are transferred between different kinds urban passenger and external transport. They are located in close proximity to the main city highways, stops of high-speed passenger transport, terminal stations of the metro, in under-stage spaces. Designed to accommodate organized parking areas for vehicles, in order to unload the main city highways and optimize the movement of vehicles.

9. Intercepting parking lots - objects of capital construction for garage purposes, located in close proximity to the terminal stations of the metro, large stations of ground, including railway, transport, intended for unloading the main city highways, optimizing the movement of vehicles. The operation of "intercepting" parking lots provides for the mode of "temporary organized parking of vehicles for dual purposes": in the daytime - in the mode of "intercepting" parking of vehicles arriving at public facilities; at night for the storage of vehicles of city residents.

10. Underground parking lots and parking lots - capital construction objects located in the underground space of the road network or residential and non-residential facilities, intended for the placement of organized places for permanent storage and parking of vehicles.

11. Mechanized (automated) multi-level parking lots and parking lots are capital construction objects and are not capital, detached and built-in-attached pre-fabricated factory structures, provided for the placement of organized storage or parking places for cars.

12. Commercial objects in which organized places of permanent storage and parking of cars are located - built-in objects of capital construction of garage purpose, intended for placement of organized places for permanent storage and parking of vehicles, the construction of which is technologically connected with the construction of non-residential objects (office, administrative and shopping centers etc.), as well as detached objects encumbered with property rights.

13. Government customer - the Moscow City Construction Department, or another Moscow city executive body authorized to place a government order.

14. Applicants:

14.1. State Unitary Enterprise "Directorate for the construction and operation of garage facilities in the city of Moscow", acting as an applicant in the construction of capital garage facilities in the following areas: in complex residential development; compensation objects for garage purposes; transport hubs; intercepting parking lots; mechanized multi-level parking lots and parking lots on land plots free of encumbrances.

14.2. Homeowners 'associations (homeowners' associations), as well as a public organization of motorists of the city of Moscow, which has a lease agreement for a land plot, regardless of the term of the agreement or earlier decisions by the executive authorities of the city of Moscow for the placement of a "flat" parking lot, included in the Register of Public Organizations of Motorists of the City of Moscow in prefecture of the administrative district of the city of Moscow, acting as the applicant in the construction of capital garage facilities at the location of "flat" parking lots.

14.3. An initiative group of motorists, registered as a public organization of motorists in the city of Moscow, included in the Register of public organizations of motorists in the city of Moscow in the prefecture of the administrative district of the city of Moscow, acting as an applicant in the construction of garage facilities on land plots free of encumbrances.

14.4. A legal entity that owns or leases a land plot and carries out the construction of garage facilities on this land plot at the expense of its own or attracted funds.

14.5. Other legal entities and individuals engaged in the construction of capital garage facilities in accordance with the legislation of the Russian Federation.

III. Structure of types and volumes of annual construction of garage facilities

1. Organized places of permanent storage of cars:

1.1. Capital objects for garage purposes in complex residential development - 22,500 parking spaces

1.2. Capital compensation objects for garage purposes - 10,000 parking spaces

1.3. Capital objects of garage designation at the location of "flat" parking lots - 40,000 parking spaces

1.4. Competitive objects (capital) for garage purposes - 12,500 parking spaces

1.5. Commercial facilities that house organized storage facilities for cars - 20,000 parking spaces

2. Organized parking places for cars:

2.1. Transport interchange hubs (TPU) - 5000 parking spaces

2.2. Intercepting parking lots - 5000 parking spaces

2.3. Underground parking lots - 6000 parking spaces

2.4. Mechanized multi-level parking - 5000 parking spaces

2.5. Commercial objects in which organized parking spaces are located - 9000 parking spaces

IV. Sources of financing for the construction of garage facilities

1. For the design and construction of capital garage facilities in complex residential development, financing is carried out at the expense of:

1.1. Moscow budget funds for the development of design and survey work with subsequent transfer design and estimate documentation with the conclusion of Moskomexpertiza for temporary use in the State Unitary Enterprise "Directorate for the construction and operation of garage facilities in the city of Moscow", for the construction of engineering networks, compensation for citizens of a part of the credit rate in the implementation of the social mortgage system and / or expenses for the construction of m / places for certain categories of citizens of the city of Moscow, determined in the manner established by the Government of Moscow.

1.2. Funds raised during construction and installation work, commissioning, registration of ownership of a newly commissioned facility;

2. For the design and construction of capital compensation objects for garage purposes, financing is carried out at the expense of:

2.1. Moscow budget funds for the development of design and survey work with the subsequent transfer of design estimates with the conclusion of Moskomexpertiza for temporary use in the State Unitary Enterprise "Directorate for the construction and operation of garage facilities in the city of Moscow", for the construction of engineering networks, compensation for citizens (monetary value) confiscated garage; compensation to citizens of a part of the credit rate in the implementation of the social mortgage system, and / or expenses for the construction of m / places to certain categories of citizens of the city of Moscow, determined in the manner established by the Government of Moscow.

2.2. Funds of individuals during construction and installation work, commissioning, registration of ownership of a newly commissioned facility.

3. For the design and construction of capital garage facilities at the location of "flat" parking lots, financing is carried out at the expense of:

3.1. Moscow budget funds for the development of design and survey work with the subsequent transfer of design estimates with the conclusion of Moskomexpertiza for temporary use in the State Unitary Enterprise "Directorate for the construction and operation of garage facilities in the city of Moscow", for the construction of engineering networks, compensation for citizens of a part of the credit rate in the implementation of the social mortgage system, and / or expenses for the construction of m / places for certain categories of citizens of the city of Moscow, determined in accordance with the procedure established by the Government of Moscow.

3.2. Funds of individuals during construction and installation work, commissioning, registration of ownership of a newly commissioned facility.

4. For the design and construction of competitive (capital) garage facilities, financing is carried out at the expense of:

4.1. Moscow budget funds for the development of pre-project documentation, the formation of the site;

4.2. Funds raised in the development of design and survey work, construction of intra-quarter utilities, construction and installation works, commissioning, registration of ownership of a newly commissioned facility.

5. For the design and construction of commercial facilities in which organized places for permanent storage and parking of cars are located, financing is carried out at the expense of:

5.1. Funds from the budget of the city of Moscow for the development of pre-project documentation, the formation of a site for the subsequent organization and conduct of tenders;

5.2. Funds raised for the development of pre-project documentation (for re-profiling a land plot), design and survey work, construction of intra-quarter utilities, construction and installation works, commissioning, registration of ownership of a newly commissioned facility.

6. For the design and construction of transport interchange hubs, financing is carried out at the expense of:

6.1. Moscow budget funds for the development of design and estimate documentation with the subsequent transfer of design and estimate documentation with the conclusion of Moskomexpertiza for temporary use in the State Unitary Enterprise "Directorate for the construction and operation of garage facilities in the city of Moscow", for the construction of engineering networks.

6.2. Funds of legal entities during construction and installation works, commissioning, registration of property rights of the city of Moscow for a newly commissioned facility.

7. For the design and construction of intercepting parking lots, financing is carried out at the expense of:

7.1. Moscow budget funds for the development of design and survey work with the subsequent transfer of design estimates with the conclusion of Moskomexpertiza for temporary use in the State Unitary Enterprise "Directorate for the construction and operation of garage facilities in the city of Moscow", for the construction of engineering networks;

7.2. Funds of legal entities during construction and installation works, commissioning, registration of property rights of the city of Moscow for a newly commissioned facility.

8. For the design and construction of underground parking lots and parking lots, financing is carried out at the expense of:

8.1. Funds from the budget of the city of Moscow for the development of pre-project documentation, the formation of a site for the subsequent organization and conduct of tenders;

8.2. Funds raised for the development of design and survey work, construction of intra-quarter utilities, construction and installation works, commissioning, registration of ownership of the newly commissioned facility.

9. For the design and construction of multi-level mechanized (automated) parking lots, financing is carried out at the expense of:

9.1. Moscow budget funds for the development of pre-design documentation, the formation of a site or the development of design and survey work with the subsequent transfer of design estimates with the conclusion of Moskomexpertiza for temporary use in the State Unitary Enterprise "Directorate for the construction and operation of garage facilities in the city of Moscow";

9.2. Funds raised for the development of design and survey work, construction of intra-quarter utilities, construction and installation works, commissioning, registration of ownership of the newly commissioned facility.

10. For the design and construction of commercial facilities in which organized places for permanent storage and parking of cars are located, financing is carried out at the expense of:

10.1. Funds from the budget of the city of Moscow for the development of pre-project documentation, the formation of a site for the subsequent organization and conduct of tenders;

10.2. Funds of legal entities for the development of pre-design documentation (when re-profiling a land plot), design and survey work, construction of intra-quarter utilities, construction and installation works, commissioning, registration of ownership of a newly commissioned facility.

V. Procedure for the design and construction of garage facilities on the territory of the city of Moscow

(Title as amended by the Decree of the Moscow Government dated November 3, 2015 N 724-PP.

1. Preliminary agreement on the provision, provision of a land plot for the design and construction of garage facilities

(Subsection as amended, entered into force on November 16, 2015 by the decree of the Moscow Government dated November 3, 2015 N 724-PP.

1.1. Preliminary approval of the provision (provision) of a land plot for the design and construction of garage facilities is carried out on the grounds and in the manner established by the Land Code of the Russian Federation.

1.2. As part of the preparation of the issue of preliminary approval of the provision of a land plot for the design and construction of garage facilities for consideration by the City Planning and Land Commission of the city of Moscow after considering this issue at a meeting of the Working Group of the City Planning and Land Commission of the City of Moscow on urban planning activities the draft decision on the preliminary approval of the provision of a land plot (hereinafter referred to as the draft decision) shall be sent by the Moscow City Property Department to the Council of Deputies for approval.

1.3. A draft decision shall be considered approved if, within 30 days from the date of receipt of the said draft by the Council of Deputies, as a result of an open vote, two-thirds of the established number of deputies of the Council of Deputies do not vote against its approval.

The decision of the Council of Deputies to refuse to approve the draft decision is sent to the Moscow City Property Department within 3 days from the date of its adoption.

1.4. The Moscow City Property Department, within 3 days from the expiration of the time period for approval of the draft decision with the councils of deputies specified in paragraph 1 of paragraph 1.3 of this section, shall send materials to the Moscow City Committee for ensuring the implementation of investment projects in construction and control in the field of shared construction to raise the issue on consideration of the City Planning and Land Commission of the city of Moscow.

1.5. After the City Planning and Land Commission of the city of Moscow has made a decision on preliminary approval of the provision of a land plot for the design and construction of a garage facility, the Department of City Property of the city of Moscow makes, in the prescribed manner, a decision on preliminary approval of the provision of a land plot, on the basis of which the provision of a land plot is carried out in accordance with the established procedure.

2. Designing an object

2.1. The applicant / developer carries out, in accordance with the established procedure, the involvement of the Customer for the organization of the design and construction of a capital garage facility. In the event of a lease agreement for a land plot for design and construction with a public organization of motorists in the city of Moscow, the Developer shall draw up an agreement for performing the functions of the Customer with the State Unitary Enterprise Directorate for the Construction and Operation of Garage Objects in the City of Moscow or with another organization that has the appropriate license.

2.2. The applicant / developer or the Customer prepares an architectural and planning assignment (APZ).

2.3. The applicant / developer or the Customer ensures the receipt of technical conditions for connection to the networks of engineering and technical support of a capital construction object, and also obtains a permit for technological connection to electrical networks.

2.4. The applicant / developer or the Customer provides the preparation of the technical assignment for the performance of engineering surveys.

2.5. The applicant / developer or the Customer ensures the preparation and submission of a report on the results of engineering surveys.

2.6. The applicant / developer or the Customer prepares and approves the assignment for the design of the facility.

2.7. The applicant / developer or the Customer is developing the project.

2.8. The applicant / developer or the Customer coordinates the developed design and estimate documentation.

2.9. The applicant / developer or the Customer ensures the receipt of the conclusion of the Mosgosexpertiza on the materials of the developed design and estimate documentation.

2.10. The applicant / developer or the Customer approves the design and estimate documentation (if there is a positive conclusion of the IGE).

3. Construction of the facility

3.1. The applicant / developer or the Customer enters into an agreement with the General Contractor for the construction of an object with the status of a participant in a self-regulatory organization in construction industry the city of Moscow or having an appropriate license to perform these works. If the Developer or the Customer has an appropriate license, the functions of the general contractor can be performed independently.

3.2. The applicant / developer or the Customer sends an application for a permit for the construction of an object to Mosgosstroynadzor with the attachment of a set of documents provided for in Article 51 of the Town Planning Code of the Russian Federation.

3.3. Issuance by Mosgosstroynadzor of a permit for the construction of an object.

3.4. The applicant / developer or the Customer (by power of attorney) publishes information about the construction project in the media and carries out the execution of contracts for participation in shared construction with physical or legal entities in accordance with the requirements of Federal Law No. 214-FZ of December 30, 2004 "On participation in the shared construction of apartment buildings and other real estate objects and on amendments to certain legislative acts of the Russian Federation" (Appendix to the Regulations on the procedure for the design and construction of garage facilities in the city of Moscow and the construction of garage facilities in the city of Moscow).

3.5. The applicant / developer or the Customer prepares the passport of the object for transfer to Mosgosstroynadzor.

3.6. The applicant / developer or the Customer prepares the land plot for transferring it to the General Contractor on the basis of the relevant contract for the performance of general contracting works.

3.7. The general contractor carries out a complex of preparatory period works at the site.

3.8. The general contractor performs zero cycle works.

3.9. The general contractor carries out the construction of the facility.

3.10. The general contractor carries out work on the improvement of the territory.

4. Putting the facility into operation

4.1. The applicant / developer or the customer, together with the General Contractor, apply to Mosgosstroynadzor to commission the facility.

4.2. Mosgosstroynadzor is issuing an opinion on the commissioning of the facility.

5. Registration of property rights

The applicant / developer, participants in shared construction provide, in accordance with the established procedure, a package of documents to the Office of the Federal Registration Service for the city of Moscow for registration of ownership rights to an object or parking space.

3.1. The developer undertakes:

3.1.1. To represent the interests of the Participant in shared construction in relations with other legal entities, authorities and management at the stage of construction of the garage complex.

3.1.2. Monitor the progress of the construction of the garage complex.

3.1.3. Provide in a timely manner to the Commissioner of the Moscow Government

By a participant in shared construction, confirmation of the work performed (form KS-2, KS-3) to make the necessary payments and settlements under contracts and obligations of the Developer with the Customer and the involved organization (general contractor).

3.1.4. Ensure the delivery of the garage complex to the acceptance committee upon completion of construction.

3.1.5. After the completion of the construction of the garage complex and putting it into operation, as well as subject to the proper fulfillment by the Participant of the shared construction of its obligations under this Agreement, to transfer to the Participant of the shared construction the Object specified in clause 1.2 according to the acceptance certificate of the garage complex, which is signed by the authorized representatives of the Parties.

3.1.6. Prepare and, within two months after the commissioning of the constructed garage complex on the balance sheet of the operating authorities, subject to the proper fulfillment by the Participant of the shared construction of its obligations under this Agreement, transfer to the Participant of the shared construction a set required documents for registration of property rights.

3.1.7. The Developer is obliged to transfer to the Participant of the shared construction the Object, the quality of which complies with the terms of the Agreement and the approved project documentation.

3.2. A participant in shared construction undertakes:

3.2.1. Fulfill the obligations specified in clause 2.2 of this Agreement.

3.2.2. Independently, at their own expense, carry out the actions established by law to register ownership of the Object, as specified in clause 1.2.

3.2.3. Sign the Certificate of Transfer of the Parking Lot (Appendix N 1) in the completed

construction of a parking garage at:

3.2.4. Sign the Transfer and Acceptance Certificate of the displayed garage (Appendix N 2),

3.2.5. Use the object in accordance with its purpose.

3.3. A participant in shared construction has the right to:

3.3.1. Within two months after the commissioning of the constructed garage complex to the balance of the operating authorities, receive the Object under the Acceptance and Transfer Act and register the title to it in the manner prescribed by law.

3.3.2. Receive, upon written request, all the necessary information on the progress of the implementation of the Facility construction program.

The assignment by the Participant of the shared construction of the rights of claims under the Agreement is not allowed on the basis of clause 2 of Article 388 of the Civil Code of the Russian Federation.

4. Responsibility of the Parties

4.1. The Parties are responsible for non-fulfillment or improper fulfillment of obligations assumed under this Agreement, in accordance with the current legislation of the Russian Federation and the terms of this Agreement.

5. Modification and termination of the Agreement

5.1. This Agreement may be amended or terminated by agreement of the Parties. All changes are made in writing and are an integral part of this Agreement.

5.2. The Developer has the right to unilaterally terminate this Agreement if the Participant in shared construction has not made investment contributions in accordance with clause 2.2 of this Agreement.

5.3. A participant in shared construction unilaterally has the right to refuse to execute the Agreement in the event the Developer fails to fulfill the obligations specified in clause 1.3 of this Agreement.

5.4. In case of early (before the end of the construction of the Object) termination of the Agreement on the initiative of the Participant in shared construction, the amount of investment received from him in accordance with clause 2.1 of this Agreement is returned to him.

6. Circumstances exonerating from liability

6.1. The Parties to the Agreement are exempt from liability for partial or complete failure to fulfill their obligations under this Agreement if this failure was the result of force majeure circumstances that arose after the conclusion of the Agreement as a result of extraordinary events that the Parties could neither foresee nor prevent by reasonable measures.

6.2. Force majeure circumstances are determined by the current civil law Russian Federation.

6.3. The Party referring to force majeure circumstances is obliged to immediately inform the other Party about the occurrence of such circumstances in writing.

6.4. If the state of non-fulfillment of obligations caused by force majeure circumstances lasts more than two months and it is not possible to make a mandatory statement on the date of termination of the circumstances within two months, then each participant has the right to terminate this Agreement unilaterally, notifying the other Party about it.

6.5. The obligation to prove force majeure circumstances lies with the Party that refers to these circumstances.

7. Additional terms

7.1. The timing of the completion of construction, the quality of the constructed Object provided to the Participant of shared construction are determined by the norms adopted in the field of construction, and are fixed by contractual obligations between the Developer and the general contractor.

7.2. The quality of the constructed Object, its compliance with the project, construction and technical rules and regulations are confirmed by the acceptance certificate of the garage complex by the acceptance committee.

7.3. When concluding this Agreement, the parties proceed from the fact that the certificate of quality of the shared construction of the Facility transferred to the Participant, its compliance with construction and technical norms and rules is the signing by the State Acceptance Commission of the acceptance certificate of the completed construction of the Facility for operation.

7.4. The transfer of the Object by the Developer and its acceptance by the Participant of the shared construction is carried out according to the deed of transfer signed by the Parties for the commissioning of the garage complex no later than two months from the date of receipt of the permit.

7.5. The Developer, at least one month before the transfer of the Object, sends to the Participant in shared construction a message on the completion of construction of the Object in accordance with the Agreement and on the readiness of the Object for transfer, as well as to warn the Participant in shared construction about the need to accept the Object and the consequences of inaction of the Participant in shared construction.

7.6. A participant in shared construction, having received a message from the Developer about the completion of the construction of the garage complex and about the readiness of the Object for transfer, is obliged to proceed with its acceptance within the period specified in the Agreement or, if no such period has been established, within seven working days from the date of receipt of the specified message.

7.7. If the Participant in shared construction evades accepting the Object within the period provided for in this Agreement, or if the Participant in shared construction refuses to accept the Object, after one month from the day stipulated by the Agreement for transferring the Object to the Participant in shared construction, the Developer shall have the right to draw up a unilateral act on the transfer of the Object (for except for the case of early transfer of the Object).

7.8. This Agreement is subject to state registration and is considered concluded from the moment of such registration. The costs of state registration of the Agreement and ownership of the Object shall be borne by the Participant in shared construction at its own expense.

7.9. All changes and additions to this Agreement are made in writing in the form of additional agreements, which are an integral part of this Agreement.

7.10. This Agreement has been drawn up in three copies of equal legal force, one for each of the Parties and one copy in the case of the documents of title of the registering authority.

8. Dispute Resolution

8.1. The parties undertake to take all necessary actions to settle disputes through negotiations.

8.2. Disagreements and disputes not settled through negotiations are resolved in court in accordance with applicable law.
