As a rule, obtaining the IRD necessary for the construction, reconstruction, technical re-equipment and overhaul of buildings and structures occurs in parallel with the process of their design, and is carried out by the investor (developer), the owner of the land or a person acting in his interests, called the technical customer. The activity of a technical customer is called project support or, more fully, legal support for the construction of buildings and structures recognized as "capital" on the basis of the legislation of the Russian Federation.

Unlike project documentation, IRD is not a product of the designer's creativity, and, therefore, is the subject of copyright, issued to the applicant by a special authority or an authorized organization for a fixed fee and without fail (subject to compliance with all regulatory requirements).

Cases when a building permit is not required are enshrined in (clause 17 of article 51 of the GRKRF).

Development of materials for pre-design studies and registration of a set of initial permitting (IRD) documentation is initial stage the investment process, the basis in which the qualitative characteristics and financial and economic parameters of the future real estate object are determined.
Initial permitting documentation (IDD) for registration of the right to design is developed on the basis of pre-design urban planning documentation approved or agreed in the established manner, in particular territory planning project (PPT).
In the absence of urban planning documentation for the territory of the planned construction developed, approved or agreed in accordance with the established procedure, the Technical Customer needs to organize the implementation of architectural pre-design studies, prepare and agree on an urban planning justification for the location of the object.

In the process of drawing up a set of initial permits (IDD), if necessary, it may be necessary to develop additional pre-design materials and perform the following set of works:

The beginning of development design and estimate documentation for the construction of a real estate object, a pre-project preparation period is preceded, consisting of two stages:
    • pre-investment (development of a territorial planning project);
    • investment (development of urban planning justification for the placement of a construction object, preparation of initial permits).

Territory planning project (from Art. 42 of the Civil Code of the Russian Federation)

Territory planning project (PPT) - a document that establishes, on a certain territory, the location zone and parameters of existing facilities and facilities, the construction of which may be permitted. It is developed simultaneously with the project of land surveying, containing a diagram of the boundaries of existing land plots and land plots, the formation of which is permissible.

PPT is developed in the development of master plans or, in their absence, as a rule, for the territory of a quarter or microdistrict, which in the town planning legislation are called elements of the planning structure. The PPT contains the main indicators necessary to determine the investment attractiveness of the territory - the population and the possible volume of new construction (housing, business, social, cultural, domestic, transport, engineering), approved by a state or municipal authority with the obligatory observance of the procedure of public hearings in accordance with article 46 Urban Development Code RF. The drawing developed as part of the PPT is the basis for subsequent types design work... PPT is the basis for the formation of urban planning plans for land plots required to obtain a building permit.

It is necessary to distinguish the concept of TPA from the concept of "master plan". Unlike master plan, which is a document with enlarged indicative indicators, the PPT is a more detailed document of urban planning regulation, containing red lines, facilities and infrastructure. The general settlement plan, unlike the PPT, does not contain the necessary data to assess the possibility of construction. Based on the approved PPT, it is issued town planning plan land plot (GPZU) required to obtain a building permit.

Urban plan of the land plot (GPZU)

Urban plan of a land plot - a type of documentation for the planning of the territory. Preparation of urban planning plans for land plots is carried out in relation to built-up or intended for construction, reconstruction of capital construction facilities (except for linear facilities) land plots.

It is provided to the developer by the authorities and, in fact, is the coordination of the main design decisions, which makes it possible to carry out further actions to implement the investment project.

The concept of an urban planning plan for a land plot was introduced by the Urban Planning Code of the Russian Federation of December 29, 2004 N 190-FZ. The Urban Planning Code of the Russian Federation of 05/07/1998 N 73-FZ did not provide for the preparation of such a document - coordination with the authorities or local government was carried out after the completion of the project documentation.

The development of design documentation was carried out on the basis of architectural and planning decisions, which were issued in accordance with the Federal Law of November 17, 1995 N 169-FZ "On architectures / lifont face = left activity in the Russian Federation". In Moscow, in 2004-2008, a document of a similar purpose was called "an act of permitted use of a plot of the territory of an urban planning object (land plot) for construction, reconstruction".

The introduction of such a document as a town-planning plan of a land plot makes it possible to transfer the main part of the approvals to the pre-design stage, to reduce the design time and the duration of the investment cycle. At the same time, construction approvals still take 1.5-2 years or more; Already not President D. A. Medvedev intends to simplify these procedures and reduce the approval time to 3-4 months.

The legislation provides for the following types of documentation for the planning of the territory:

  • territory planning projects;
  • land surveying projects;
  • town planning plans of land plots.

The preparation of a town planning plan for a land plot is carried out as part of a land survey project or in the form of a separate document. The urban planning plan of the land plot as a separate document can be issued to legal entities and individuals upon their application.

The urban planning plan of a land plot is used for the development of project documentation, the development of a draft of the boundaries of a built-up (or building-up) land plot, and subsequently - for issuing a building permit and a permit for commissioning an object.

Plan composition

The form of the urban planning plan of the land plot was approved by the Order of the Ministry of Regional Development of the Russian Federation. The instructions on how to fill out the urban planning plan for the land plot have been published by the Ministry of Regional Development. The urban development plan of the land plot includes:

  • plan number, cadastral number and name of the applicant (preamble);
  • drawing of the town-planning plan of the land plot;
  • information on urban planning regulations for the land plot;
  • information on the permitted use of the land plot;
  • information about capital construction objects and cultural heritage;
  • information on the technical conditions for connecting to engineering networks;
  • information on the possibility of dividing the site.

In certain cases, the legislation of Moscow also provides for the development of an urban planning justification, which is absent in federal legislation.

Preparation and issuance of an urban planning plan for a land plot

Preparation of a town-planning plan of a land plot for built-up plots as part of a land-surveying project can be carried out only on the basis of territorial planning documents. In most cases, the preparation of a town planning plan for a land plot can be carried out by the applicant, but it is still approved by the authorities.

The Town Planning Code does not indicate to whom and on what basis the Town Planning Plan is issued. The issuance procedure is determined by the authorities. Therefore, as a rule, a town planning plan for a land plot is issued only to a person interested in the construction or reconstruction of an object (developer), who must prepare all the basic documents.

According to the legislation, the issuance of an urban development plan for a land plot is free of charge for the applicant.

  • Until December 31, 2013, in relation to land plots intended for construction, reconstruction of linear facilities, town planning plans of land plots may be provided in the manner established by the Town Planning Code of the Russian Federation ( the federal law from 29.12.2004 N 191-FZ).

  1. Preparation of urban planning plans for land plots is carried out in relation to built-up or intended for construction, reconstruction of capital construction facilities (except for linear facilities) land plots.

  3. As part of the urban planning plan of the land plot, the following shall be indicated:

    2. the boundaries of the zones of action of public easements;
    3. minimum indents from the boundaries of the land plot in order to determine the places of permissible placement of buildings, structures, structures, outside of which the construction of buildings, structures, structures is prohibited;
    4. information on town planning regulations (if the land plot is subject to urban planning regulations). At the same time, the urban planning plan of a land plot, with the exception of cases of providing a land plot for state or municipal needs, must contain information on all types of permitted use of a land plot provided for by town planning regulations;
    5. information on the permitted use of the land plot, requirements for the purpose, parameters and location of the capital construction object on the specified land plot (in cases where the urban planning regulations do not apply to the land plot or the town planning regulations are not established for the land plot);
    6. information about capital construction objects located within the boundaries of the land plot, objects of cultural heritage;
    7. information on the technical conditions for connection (technological connection) of capital construction objects to the networks of engineering and technical support (hereinafter referred to as the technical conditions);
    8. the boundaries of the zone of the planned location of capital construction objects for state or municipal needs.
4. The urban planning plan of a land plot may include information on the possibility or impossibility of dividing it into several land plots.
5. The form of the town-planning plan of the land plot shall be established by the federal executive body authorized by the Government of the Russian Federation.

Inspection of buildings and structures

This is a document that contains technical standards developed for a specific capital construction facility. In special technical conditions (STU), additional construction features are displayed, when during the design of objects of various types it is not possible to comply with all norms and requirements.

All requirements that will be specified in the STU will be prioritized in the design and construction process throughout the entire territory of the Russian Federation. Sometimes, it is necessary for Russia, if there is additionally part of the collateral fire safety.
In general, today there are several types of special technical conditions at once. The type of documentation is determined by the nature of the described requirements in it, as well as the scope of standardization of special specifications.

When is the development and approval of special technical conditions (STU) required for capital construction facilities?


1. If the object has design solutions that differ from the regulatory requirements of the legislation of the Russian Federation on fire safety.
2. If the normative and technical documentation does not establish the requirements for the object. In other words, the facility is distinguished by its uniqueness and technical complexity - we are talking about air terminal complexes, high-rise buildings, oil-producing platforms.

The basis for the development and approval is the absence of basic design standards for those objects that have special unique parameters.



STUs are developed in accordance with the approved order of the Ministry of Regional Development of the Russian Federation dated 01.04.2008 No. 36.

It is this approach that enables investors and designers to effectively use the STU as a document that allows them to regulate all non-compliance of the project with fire safety requirements, while maintaining the ability to apply solutions that are important for the investor (technical and economic feasibility).

Depending on how the facility planned for construction complies with the current regulatory provisions, STUs can be developed in three types:

    This Regulation on technical conditions for the design and construction of unique, high-rise and experimental capital construction projects in the city of Moscow establishes general recommended rules for their construction, presentation, design and the procedure for their approval and approval prior to the adoption of the relevant technical regulations.

    2. Basic provisions

    2.1. Technical conditions (hereinafter referred to as TU) containing safety requirements and developed in accordance with the requirements of this Regulation, the legislation of the Russian Federation and current regulatory documents, after their approval by the relevant federal executive body in the established field of activity, approval by the investor or customer-developer, are a regulatory and technical document for the preparation of design documentation for a specific capital construction object, including the construction of facade systems.

    The specified technical specifications are an integral part of the design documentation for a specific object.

    2.2. Specifications for the design and construction of unique, high-rise and experimental capital construction projects in the city of Moscow are intended for use by design and construction organizations, investors and customers-developers.

    The types of unique, high-rise and experimental capital construction objects to which this Regulation applies are given in.

    2.3. The basis for the preparation of the technical specification is the technical assignment (hereinafter referred to as the technical specification) approved by the investor or the customer-developer, taking into account the specifics of a particular object. The requirements of the TK must meet MRR-2.2.13-06 "Manual for the preparation and execution of assignments for the development of project documentation for civil and industrial use, construction projects, engineering networks and road transport facilities ".

    2.4. TU must contain requirements for all sections of the project.

    Depending on the characteristics of a particular object, it is allowed to develop technical specifications containing one or more sections.

    The list of TU sections is given in these Regulations.

    2.5. The requirements established by the TU should not contradict the mandatory requirements established by the legislation and legal acts of the Russian Federation, and the current regulatory documents of federal executive bodies, as well as the standards for urban planning of the city of Moscow.

    TU requirements should be based on advanced experience and on modern achievements of domestic and foreign science, technology and technology.

    2.6. If individual requirements established in the current regulatory and technical documents in the field of construction apply to specific design products for a specific facility, then these requirements are not repeated in the TU, and in the corresponding sections of the TU references are given to these regulatory and technical documents in accordance with GOST 2.105 -79 "ESKD. General requirements to text documents ".

An investor or a customer-developer, prior to approval and (or) prior to the approval of the TU in the prescribed manner, may receive the conclusion of the Scientific and Technical Council of the Moscow Committee for Architecture and Construction on the compliance of the project with the TU.

    The procedure for agreeing and approving the technical specifications is given in these Regulations.

    2.8. The procedure for organizing and conducting scientific and technical assessment of technical specifications is given in these Regulations.

    2.9. The procedure for recording, storing agreed and approved technical specifications that have undergone scientific and technical assessment is similar to the procedure adopted for project documentation.

    3. Rules for the construction, presentation and registration of technical specifications

    3.1. TU should contain an introductory part and the following sections, arranged in sequence:

    appointment and general characteristics capital construction object;

    special technical requirements, taking into account the features:

    architectural and planning solutions,

    general requirements for organizing the construction of an object,

    bases, foundations and underground part of the facility,

    design solutions for the above-ground part of the facility, including the design of facade systems, taking into account the requirements for energy efficiency;

    requirements for the engineering support of the facility, including the requirements:

    to the thermal protection of the facility,

    to water supply, sewerage and drains,

    to heat supply, heating, ventilation, air conditioning and cold supply,

    to elevators, garbage and dust collection,

    power supply, electrical devices,

    electric lighting,

    automated complexes, communications and information;

    requirements for monitoring engineering systems and structures;

    environmental protection requirements.

    Separate sections define safety requirements, taking into account sanitary and hygienic requirements, requirements for constructive, fire, biological, chemical safety, including anti-terrorist protection of the facility, etc., providing a set of security measures, depending on the specifics of the facility.

    The specific composition of the sections and the completeness of their content is determined by the developer of the technical specifications in accordance with the requirements of the technical specifications for the design of the facility.

    3.2. The contents of the listed sections, except for the sections: "Purpose and general characteristics of the object", "Normative references", "Special technical requirements", "Safety requirements", "Requirements for monitoring engineering systems and structures", "Environmental protection requirements", must meet the requirements of MGSN 4.19-2005 and the requirements of the investor or customer-developer.

    3.3. The text of TU in accordance with the requirements of GOST 2.114-95 "ESKD. Technical conditions" should be short, accurate, not allowing different interpretations, logically consistent and sufficient for use in accordance with the stated field of application.

    When stating the mandatory requirements in the text of the TU, the words "must", "should", "necessary", etc. should be used.

    3.4. The text of the TU is drawn up on A4 sheets. The TU designation is indicated on each sheet in the upper right corner (for simplex printing) or in the left corner of even-numbered pages and the right corner of odd-numbered pages (for duplex printing).

    3.5. Diagrams, drawings and tables illustrating individual provisions of the technical specifications are performed on sheets of formats in accordance with GOST 2.301-68 "ESKD. Formats".

    3.6. The designation TU is assigned by the developer in agreement with the investor or customer-developer, taking into account the following provisions:

    TU 001-38576343-2007 "Specifications for fire protection ..." - the name of the capital construction object, where:

    001 - three-digit registration number assigned by the TU developer;

    38576343 - code of the organization according to the All-Russian Classifier of Enterprises and Organizations (OKPO) - the owner of the TU;

    2007 - the year of TU approval.

    In this case, the signatures of persons provided for in the main inscription in accordance with GOST 2.104-68 "ESKD. Basic inscriptions" are indicated on the title page.

    4. The order of agreement and approval of technical conditions

    4.2. TUs are approved without limitation of validity period.

    4.3. The need for coordination with other interested organizations in the presence of requirements related to their competence is determined by the developer together with the investor or developer-customer.

    4.4. TU approval is drawn up in accordance with GOST 2.114-95 "ESKD. Specifications".

    5. Scientific and technical assessment of technical conditions

    5.1. The grounds for conducting a scientific and technical assessment of the TU project intended for the preparation of design documentation and construction (reconstruction) of unique, high-rise and experimental capital construction facilities in Moscow are:

    applications submitted by investors or customers-developers, or individuals (hereinafter referred to as applicants);

    orders, orders, instructions of the Mayor of Moscow, subordinate structures of the Moscow Government, instructions of the heads of state bodies for supervision and examination of projects;

    decisions of law enforcement and judicial authorities.

    5.2. The applicant submits for the scientific and technical assessment of the NTS Moskomarkhitektura (hereinafter - NTS) draft TU.

    5.3. The conclusion of the STC based on the results of the scientific and technical assessment of the TU project is issued on the basis of the conclusions of the relevant Working Committees of the STC and the conclusions of the organizations entered by the Moscow Committee for Architecture in the Register of accredited specialized research and other organizations carrying out work on the scientific and technical assessment of the TU project, and (or) conclusions drawn by specialist experts (hereinafter - experts).

    5.4. The conclusion of the NTS Moskomarkhitektura is approved by the chairman of the NTS Moskomarkhitektura.

    5.5. When conducting a scientific and technical assessment of a project, TUs are guided by technical regulations, interstate (international) and national standards, building codes and regulations (SNiP), codes of practice (SP), norms and standards of state supervision bodies, Moscow city building codes (MGSN).

    5.6. The procedure for performing the scientific and technical assessment of the TU project is carried out in accordance with the Regulations of the Scientific and Technical Council of the Architectural Council of the Moskomarkhitektura, approved by the chairman of the Moskomarkhitektura on 02.10.2006, and the order of the Moskomarkhitektura dated 10.07.2006 N 16 "On the scientific and technical assessment of technical conditions used for design and construction in the city of Moscow "as amended by the order of the Moscow Committee for Architecture and Construction of June 14, 2007 N 53" On amendments and additions to the order of the Moscow Committee for Architecture of July 10, 2007 N 16 ".

    5.7. To conduct a scientific and technical assessment of the TU project, the applicant submits the following materials to the Moskomarkhitektura:

    letter (statement, appeal) of the applicant;

    terms of reference for the design of a capital construction facility;

    draft TU.

    If necessary, the Moskomarkhitektura may, in addition to the above documents, request documents confirming the provision of fire, structural and other safety of the facility:

    conclusions of non-state examination of project documentation issued by accredited organizations in the manner established by the Government of the Russian Federation (if any);

    other documents confirming the safety of the materials and structures used (equipment, engineering networks, etc.).

    5.8. The term for the scientific and technical assessment of the TU project with the issuance of the STC conclusion is determined depending on the type and complexity of the object of scientific and technical assessment and cannot exceed one month.

    5.9. The work on the scientific and technical assessment of the TU project is carried out on a contractual basis between the applicant and the involved organizations and (or) experts.

    5.10. The development of project documentation by an investor or a developer-customer is carried out taking into account the positive conclusion of the Scientific and Technical Council of the Moscow Committee for Architecture and Construction on the TU project for a specific capital construction object.

    5.11. TU, agreed by the federal executive authorities in the established field of activity, passed the scientific and technical assessment of the Scientific and Technical Council of the Moscow Committee for Architecture and Construction, approved in the prescribed manner by the investor or the developer-customer, and the project documentation for a specific capital construction project, developed on the basis of the specified TU, are sent by the investor or developer- by the customer for state examination.

    5.12. The decisions taken by the NTS Moskomarkhitektury on the consideration of the draft TU are advisory.

    In the TU section for constructive solutions facade systems must reflect the following requirements:

    Regulations on technical conditions for the design and construction of unique, high-rise and experimental capital construction projects in the city of Moscow (approved by the Department of Urban Development Policy of Development and Reconstruction of Moscow on October 1, 2007)

    Technical conditions for the connection of engineering communications are the technical and economic characteristics of connecting the facilities under construction to the existing engineering communications, issued taking into account the new load from the structure being erected.

    In most cases, the owner of the networks or the operating organization issues only a connection point to engineering systems, technical regulations connections and the maximum load that the network can provide at a given point. The laying of engineering communications from a given point to the object under construction is the business of the Investor or the Developer.

    At the pre-design stage, technical conditions are issued that are necessary for a preliminary calculation of the cost of connecting the facility to utilities (Conclusion on engineering support) for a feasibility study of the project.

    At the "P" or "RD" stage, technical specifications are issued for design for a period of one to three years.

    Obtaining preliminary technical conditions (TU)

    In order to obtain preliminary technical conditions for connecting to utilities, an opinion is made on the engineering support of the construction object (power supply, heat supply, water supply, sewerage, gas).

    Coordination and receipt of technical conditions for connecting the facility to city utility networks

    The coordination and issuance of technical conditions necessary for connecting the facility to the systems of electricity, heat, gas, water supply and sewerage is carried out by the organization for the operation of engineering and technical support networks.

    The ready-made technical specifications contain data on the maximum load at possible connection points, the timing of the object's connection to the utility networks and the validity period of the technical conditions themselves.

    Rules for the determination and provision of technical conditions for connecting a capital construction object to the networks of engineering and technical support (approved by the decree of the Government of the Russian Federation of February 13, 2006 N 83)

    1... These Rules regulate the relationship between the organization operating the networks of engineering and technical support, local government bodies and the owners of land plots arising in the process of determining and providing technical conditions for connecting capital construction projects under construction, reconstructed or built, but not connected to the networks of engineering and technical support (hereinafter - technical conditions), including the procedure for sending a request, the procedure for determining and providing technical specifications, as well as criteria for determining the connectivity.

    These Rules are also applied in cases when, as a result of the construction (reconstruction) of utility networks or equipment for the production of resources, it is required to connect to technologically connected utility networks.

    2. The following concepts are used in these Rules:

    "resources" - cold and hot water, network gas, electric and thermal energy used to provide services for electricity, heat, gas and water supply;

    "networks of engineering and technical support" - a set of property objects directly used in the process of electricity, heat, gas, water supply and sewerage. When connecting capital construction facilities directly to equipment for the production of resources or to water disposal and wastewater treatment systems in the absence of a network infrastructure in the organization operating such equipment, the specified organization is an organization that operates engineering support networks in terms of providing technical conditions and fulfilling other actions in accordance with these Rules;

    "connection of a capital construction facility to engineering and technical support networks" is a process that makes it possible to connect capital construction facilities under construction (reconstructed) to engineering and technical support networks, as well as to equipment for the production of resources;

    "technologically connected networks" - owned or otherwise legal basis to organizations of a network of engineering and technical support, having mutual points of connection and participating in a single technological system of electricity, heat, gas, water supply and wastewater disposal;

    "connection point" - a place where engineering and technical support networks are connected with devices and structures necessary for connecting a capital construction object under construction (reconstructed) to power, heat, gas, water supply and sewerage systems.

    3. If the law of the subject of the Russian Federation- the city of Moscow or St. Petersburg authorities in the field of urban planning activities are not included in the list of issues of local importance, the corresponding actions, rights and obligations of local authorities are carried out by the authorized executive body of the constituent entity of the Russian Federation.

    4. When preparing a town planning plan for a land plot intended for the construction (reconstruction) of capital construction facilities, technical conditions providing for the maximum load are prepared by the local government on the basis of:

    • information on the permitted use of the land plot;
    • the limiting parameters of the permitted construction (reconstruction) of capital construction facilities established in relation to this land plot;
    • regional and (or) local standards for urban planning;
    • schemes of the existing and planned location of capital construction objects (electricity, heat, gas, water supply and sewerage) of federal, regional and local significance;
    • limiting (minimum and (or) maximum) sizes of land plots.

    In the event that the provision of certain types of resources can be carried out in various ways, the local government, when preparing a town planning plan for a land plot, determines the technical conditions for all possible methods.

    With regard to the built-up land plot, as well as after the determination of the right holder of the land plot intended for the construction (reconstruction) of capital construction objects, the urban planning plan of the land plot includes technical conditions issued to the right holder of the land plot in accordance with paragraphs 5 - 12 of these Rules.

    5. Local government no later than 30 days before the date of the decision to hold an auction for the sale of ownership (lease) of a land plot or on the provision of a state or municipal land plot for construction, or a decision on preliminary approval of the location of a capital construction object is provided to interested parties technical conditions.

    To obtain technical specifications, as well as information on the payment for connecting to engineering networks, a local government body, no later than 45 days before the date of adoption of one of these decisions, applies to the organization operating the engineering and technical supply networks, to which it is planned to connect capital construction facilities.

    6. If the owner of the land plot intends to carry out the reconstruction of a capital construction object or connect the constructed capital construction object to the engineering and technical support networks and if the technical conditions for its connection were absent or their validity period expired, and also if the validity period of the technical conditions issued by the local government as part of the documents on the provision of land plot, the right holder, in order to determine the required connected load, applies to the organization that operates the engineering and technical support networks, to which it is planned to connect the reconstructed (built) capital construction object, in order to obtain technical conditions.

    If the rightholder of the land plot does not have information about the organization issuing technical specifications, he applies to the local government with a request to provide information about such an organization, and the local government submits information about the relevant organization, including the name, within 2 working days from the date of the request. legal and actual address.

    7. The organization operating the networks of engineering and technical support, to which a request for obtaining technical conditions should be sent is determined by the local government on the basis of schemes of the existing and planned location of capital construction objects in the field of electricity, heat, gas, water supply and sewerage of federal, regional and local significance, as well as taking into account investment programs of the said organization, approved by the representative body of local self-government in the manner prescribed by the legislation of the Russian Federation, and for gas supply networks - on the basis of gasification programs approved by the authorized executive body of the constituent entity of the Russian Federation.

    If the investment program of the organization operating the engineering and technical support networks is not approved, the technical conditions are issued when the land plot is provided for integrated development with the subsequent transfer of the created engineering and technical support networks to state or municipal ownership or when connecting to the existing engineering networks. technical support and the performance of the specified organization at the expense of the owner of the land plot of work necessary to connect to the networks of engineering and technical support at the point of connection on the border of the existing networks. This condition does not apply to cases when the creation (reconstruction) of engineering and technical support networks is not required to connect to the networks of engineering and technical support of capital construction projects under construction (reconstructed).

    Local authorities (executive authorities of the constituent entities of the Russian Federation - Moscow and St. Petersburg) are recommended to accept the engineering and technical support networks created at the expense of the owner of the land outside the boundaries of the land plot into municipal (state) ownership.

    8. Request from a local government body or the owner of a land plot on the provision of technical specifications or information on the payment for connecting a capital construction object to the engineering and technical support networks, must contain:

    • name of the person who sent the request, his location and mailing address;
    • notarized copies of constituent documents, as well as documents confirming the powers of the person who signed the request;
    • title documents for a land plot (for the owner of a land plot);
    • information on the boundaries of the land plot on which the construction of a capital construction facility is planned or on which the reconstructed capital construction facility is located;
    • information on the permitted use of the land plot;
    • information on the limiting parameters of the permitted construction (reconstruction) of capital construction objects corresponding to this land plot;
    • the necessary types of resources obtained from the networks of engineering and technical support;
    • the planned date of commissioning a capital construction facility (if relevant information is available);
    • the planned value of the required connected load (if relevant information is available).

    9. Organization operating networks of engineering and technical support, is obliged, within 14 working days from the date of receipt of the request specified in clause 8 of these Rules, to determine and provide technical conditions or information on the payment for connecting the capital construction object to the engineering and technical support networks or to provide a reasoned refusal to issue these conditions in the absence of the possibility of connecting the construction of the (reconstructed) capital construction facility to the engineering and technical support networks. In order to verify the validity of the refusal to issue technical specifications, the rightholder of the land plot has the right to apply to the authorized federal executive body for technological supervision for a corresponding opinion.

    Issuance of technical specifications or information on payment for connecting a capital construction object to engineering networks is carried out free of charge.

    10. Specifications must contain the following data:

    • maximum load at possible connection points;
    • the term for connecting the capital construction object to the engineering and technical support networks, determined, inter alia, depending on the timing of the implementation of investment programs;
    • validity period of technical conditions, but not less than 2 years from the date of their issue. After this period, the parameters of the issued technical specifications may be changed.

    11. Information on the payment for connecting a capital construction object to the networks of engineering and technical support should contain:

    • data on the tariff for connection, approved at the time of issuance of technical specifications in accordance with the procedure established by the legislation of the Russian Federation;
    • the expiration date of the specified tariff (if the validity period of this tariff expires before the expiration of the technical conditions);
    • the date of re-applying for information about the connection fee (if at the time of the issuance of the technical conditions the connection tariff for the period of their validity is not set).

    If the creation (reconstruction) of utility networks is not required to connect the capital construction projects under construction (reconstructed) to the utility networks, the connection fee will not be charged.

    If the organizations operating the engineering and technical support networks to which it is planned to connect capital construction projects do not have approved investment programs, the connection is carried out without charging a connection fee, and instead of information on the connection fee, technical conditions are issued in accordance with paragraph 7 of these Rules ...

    12. In the case of a request from the owner of the land plot, which intends to carry out the reconstruction of a capital construction object or connect the constructed capital construction object to the engineering and technical support networks, if there were no technical conditions for its connection, or their validity period expired, or in the case of a request from a local government body in order to obtain information on land plots, located within the boundaries of the built-up territories, the organization operating the networks of engineering and technical support determines the technical conditions:

    • on the basis of the analysis of the capacity reserve for the production of the corresponding resources and the throughput of the engineering and technical support networks, and at the points of interconnection - together with the organizations operating technologically connected engineering and technical support networks, taking into account the above analysis;
    • taking into account the assessment of alternative options for connecting capital construction objects to the existing networks of engineering and technical support;
    • taking into account the obligations assumed by such an organization in accordance with the previously issued technical conditions to ensure the connection of capital construction objects to the networks of engineering and technical support.

    13. The possibility of connecting capital construction objects to the networks of engineering and technical support in the cases specified in paragraph 12 of these Rules exists:

    • in the presence of a reserve of network bandwidth, ensuring the transfer of the required amount of resources;
    • if there is a capacity reserve for the production of the corresponding resource.

    The absence at the time of the request of the indicated reserves is the basis for refusal to issue technical specifications, except for cases when the elimination of these restrictions is taken into account in the investment programs of organizations operating the networks of engineering and technical support.

    14. In order to confirm the availability of reserves of the throughput of utility networks, ensuring the transfer of the required volume of the resource, and (or) the capacity reserve for the production of the corresponding resource, the organization that received the request for the issuance of technical specifications shall agree on the technical conditions with the organizations owning technologically connected networks of engineering and technical support and (or) facilities for the production of this resource. The relevant organizations within 5 working days from the date of application must agree on this information or submit a written reasoned refusal.

    15. The connection of the capital construction object to the networks of engineering and technical support is carried out on the basis of an agreement. The procedure for concluding and executing the said agreement, the essential conditions of such an agreement, the rights and obligations of the parties are determined in accordance with the legislation of the Russian Federation.

    16. Obligations of the organization, which issued the technical conditions, to ensure the connection of the capital construction object to the engineering and technical support networks in accordance with such technical conditions, are terminated if, within 1 year from the date of receipt of the technical conditions, the rightholder of the land plot does not determine the connected load he needs and does not contact a statement on the connection of the capital construction facility to the networks of engineering and technical support.

    17. If the connection of a capital construction facility is possible only to the existing networks of engineering and technical support, owned or on other legal basis by a person who is a consumer of the corresponding type of resources (hereinafter referred to as the main subscriber), the technical conditions for such a connection may be issued by the main subscriber in agreement with the resource supplying (network) organization, to whose facilities the utility networks belonging to the main subscriber are connected. By agreement between the resource supplying (network) organization and the main subscriber, technical conditions can be developed by the resource supplying (network) organization.

    The fee for connecting a capital construction object to engineering networks is determined on the basis of tariffs established by a local government body for connecting a capital construction object to the communal infrastructure systems of the corresponding resource (grid) organization.

    An agreement on connecting a capital construction object to engineering networks is concluded with the main subscriber, who must conclude an agreement with a resource supplying (network) organization on connecting to engineering networks to obtain additional power. The parties can conclude a tripartite connection agreement.

    18. When changing the owner of a land plot, to which the technical conditions were issued, the new rightholder has the right to use these technical conditions by notifying the organization operating the engineering and technical support networks about the change of the rightholder.
